OF THE PLANNING COMMISSION OF THE CITY
OF CUPERTINO RECOMMENDING APPROVAL OF A
REQUEST TO MODIFY A PREVIOUSLY APPROVED
TENTATIVE MAP TO PERMIT REMOVAL OF AN
APPROXIMATELY 35 INCH OAK TREE LOCATED
ON LOT 15 OF TRACT 6943.
APPLICANT: John and Patricia Seaman

SUBMITTED: November 12, 1985
LOCATION: Oakleaf Place, Cupertino
FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and
the subconclusions as set forth in the minutes of the Planning
Commission meeting of November 12, 1985.
CONDITIONS:
1 . The oak tree located closest to the front property line of
lot 15 may be removed.
2. The oak tree located closest to the rear property line shall
be retained. Prior to issuance of a building permit, the
applicant shall submit a plan to protect this tree. Said
plan shall be prepared by a registered landscape architect
or tree surgeon.
® 3. The pad location specified in Exhibit B 3rd Revision for lot
15 may be modified to include the area which was previously
excluded in order to protect the front oak tree.
4. With the exception of the above modifications, all previous
conditions of approval applicable to Application 27-TM-79 are
hereby retained.
5. A large speciman tree (at least 24 inch box ) of a species
acceptable to staff shall be located as approved by staff'. •
PASSED AND ADOPTED this 12th day of November, at a regular
meeting of the Planning Commission of the City of the City of
Cupertino, by the following roll call vote:

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE APPROVAL OF A TENTATIVE MAP
WHEREAS , the attached application has
PP been submitted to the City
of Cupertino requesting approval of a tentative map; and
WHEREAS , the Planning Commission 'has held at least one public hearing
in regard to the application; and
WHEREAS , the Planning Commission lhasduly considered and heard all
evidence submitted in regard to said application; and
WHEREAS , the necessary public notices have been given as required
by the subdivision and procedural ordinances of the City of
Cupertino.
NOW, THEREFORE, BE IT RESOLVED:
1 . That the Planning Commission makes the following findings : 411
a. That the proposed map islconsistent with the general and
specific plans .
b. That the design or improvement of the proposed subdivision
is consistent with the general and specific plans .
c. That the site is physically suitable for the type of
development.
d . That the site is physically suitable for the proposed density
of development.
e . That the design of the subdivision or the proposed improvements
are not likely to cause substantial environmental damage or
substantially and avoidably injure fish or wildlife or their
habitat.
f . That the design of the subdivision or the type of improvements
are not likely to cause serious public health problems .
g. That the design of the subdivision or the type of improvements
will not conflict with easements , acquired by the public at
large , for access through or use of , property within the pro-
posed subdivision.
