Reso 2700 • • RESOLUTION NO. 2700 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A TENTATIVE PARCEL MAP TO SUBDIVIDE APPROXIMATELY 0.85 ACRES INTO FOUR (4) PARCELS RANGING APIN SIZE FROM APPROXIMATELY 6,200 SQ. FT. TO 6,800 SQ. FT. APPLICANT: Whaley and Associates , ADDRESS: 1885 The Alameda Suite 130 San Jose, CA. 95126 SUBMITTED: September 9, 1985 LOCATION: South side of Rainbow drive, 300 feet west of Stelling Road FINDINGS AND SUBCONCLUSIONS: Approval is subject to the findings as set forth on Page 1 and the subconclusions as set forth in the minutes of the Planning Commission meeting of October 16, 1985. CONDITIONS: 1-15. STANDARD CONDITIONS Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the- special conditions as enumerated herein shall apply. 16. APPROVED EXHIBITS That the recommendation of approval is based on Exhibit A of I) Application 20-TM-85 except as may be amended by special conditions enuTmerated herein. 17. EXISTING STRUCTURES - All existing structures within the boundaries of the subject parcel map shall be removed in order to comply with setback and use limitations of the R-.1 zoning district. The property owner or sucessor in interest may elect to retain the existing dwelling unit on Parcel One, provided that the existing detached garage is removed or relocated to comply with required R-1 zone setbacks, and that driveway access is oriented to the proposed Rainbow Court cul-de-sac. 18. LOT BOUNDARY. ADJUSTMENT The outside radius of•the proposed cul-de-sac street depicted on Exhibit A shall be enlarged to 42 feet. The width of Parcels 2 and 3 shall be adjusted as necessary in connection with the aforementioned enlargement of radius in order to satisfy the minimum lot width requirement of sixty (60) feet at front building setback line as specified in the R-1 zoning district. - 2 - RESOLUTION 2700 (20-TM-85) 10-14-85 Page - 3 19) TREE PROTECTION All specimen trees, as defined in City Ordinance 778, located within the subdivision boundary shall be retained. In addition, the subdivider shall retain the 30" and 36" Oaks located within the area to be dedicated for roadway purposes on the Rainbow Drive frontage of Parcel One. Prior to recordation of the final map, the subdivider shall consult with the Public Works Department to devise an acceptable alignment for sidewalk, curb and gutter improvements bypassing the retained trees. The subdivider shall retain a qualified arborist to evaluate the condition of all specimen trees to be retained, incl uding those located within the future public right-of-way. The arborist's evaluation shall specify steps to be taken to ensure the survival of these trees during and after construction activity. 20) DRIVEWAY ACCESS Driveway access for all parcels in the subdivision shall be oriented to the proposed Rainbow Court cul-de-sac. The subdivider shall convey.on the final. map all access rights to Rainbow Drive for Parcels 1 and 4 of the subdivision to the City of Cupertino.
