SQ. FT. TO 36,500 SQ. FT.

Approval is subject to the findings as set forth on Page 1 and
the subconclusions as set forth in the Minutes of the Planning
Commission meeting of June 10, 198.�C

conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special
conditions as enumerated herein shall apply.
16. APPROVED EXHIBITS
That the recommendation of approval is based on Exhibit A
of Application 6-TM-85 except as may be amended by
special conditions enumerated herein.
17. GEOLOGIC REVIEW
Prior to recordation of the parcel map, the applicant
shall demonstrate to the satisfaction of the Public Works
Department that there are no geological hazards which
significantly impact the future building pads. The
applicant understands that he may have to amend the
tentative parcel map in order to adjust lot lines or
modify building pads if geological hazards exist. The
parcel map shall contain a note indicating that a
geological report has been prepared and a covenant shall
be recorded informing future puchasers of the parcels
that said geological report has been prepared and copies
of said report are available for public inspection at
Cupertino City Hall .

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE APPROVAL OF A TENTATIVE MAP
WHEREAS , the attached application has been submitted to the City
of Cupertino requesting approval of a tentative map; and
WHEREAS , the Planning Commission has held at least one public hearing
in regard to the application; and
WHEREAS , the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS , the necessary public notices have been given as required
by the subdivision and procedural ordinances of the City of
Cupertino .
NOW, THEREFORE, BE IT RESOLVED :
1. That the Planning Commission makes the following findings :
a. That the proposed map is consistent with the general and
specific plans .
b . That the design or improvement of the proposed subdivision
is consistent with the general and specific plans .
c . That the site is physically suitable for the type of
development.
d . That the site is physically suitable for the proposed density
of development.
e . That the design of the subdivision or the proposed improvements
are not likely to cause substantial environmental damage or
substantially and avoidably injure fish or wildlife or their
habitat.
f . That the design of the subdivision or the type of improvements
are not likely to cause serious public health problems .
g. That the design of the subdivision or the type of improvements
will not conflict with easements , acquired by the public at
large , for access through or use of , property within the pro-
posed subdivision. ,

18. GARAGE
410 The applicant shall modify the existing garage structure
to comply with the requirements of the R1 Zoning
Ordinance.
19. STREET IMPROVEMENTS
The applicant shall install street improvements along
Mercedes Road and the San Felipe Road cul-de-sac, as
required by the Public Works Department. Said
improvements shall be limited to the subject property's
frontage along said streets. In addition, the applicant
shall sign a deferred agreement for dedication and
improvements along the paper street identified as Madera
Road.
20. EASEMENTS
•
The applicant shall prepare the appropriate
ingress/egress easements and maintenance agreements,
place them in escrow and record them with any transfer of
ownership. Said easements/agreements shall be subject to
the review and approval of the City Attorney.
Additionally, emergency fire access and turn-around
easements shall be recorded in conjunction with
recordation of the parcel map.
• 21. ACCESS - PARCEL ONE
The applicant may modify the tentative parcel map to
provide access to Parcel One from the proposed 18 ft.
driveway accessing Parcel Three, subject to staff
approval . In such case, the existing driveway to Parcel
One shall be eliminated and the applicant shall hire a
registered landscape architect or tree surgeon to prepare
a Tree Protection Plan for the Oak trees which could be
impacted by the modified driveway.
22. CREEK ACCESS - PARCEL THREE
The applicant may construct a bridge over the existing
creek near Mercedes Road in order to access Parcel Three,
subject to staff approval . Alternatively, the applicant
may fill in the creek and install a culvert. subjectg to
staff approval .
23. FRONT PROPERTY LINE - PARCEL THREE
The east property line of Parcel Three shall be
considered the parcel 's front property line.

24. TREE PROTECTION - PARCEL THREE • :.,
The applicant shall provide a Tree Protection Plan,
prepared *by a registered landscape architect or tree
surgeon, prior to building permit approval . for Parcel
Three. The plan shall include an evaluation of the
effect of construction activity on the trees and outline
measures to ensure their survival in accordance with
Ordinance No. 778.
25. BUILDING PAD CONFIGURATION
The building pad configuration shall be reviewed and
approved. by staff prior to issuance of a building permit.
