RESOLUTION NO. 2627
WOF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE
APPROXIMATELY 106 ACRES INTO 408 RESIDENTIAL LOTS
AND TWO LOTS TO BE IN COMMON OWNERSHIP.

FINDINGS AND SUSCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and
the subconclusions as set forth in the minutes of the Planning
Commission meeting of April 10, 1985.
CONDITIONS:
1-15. Standard Conditions to the extent that they do not
conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special
• conditions as enumerated herein shall apply.
16. That the recommendation of approval is based on Exhibits
A and B of Application 3-TM-85 except as may be amended
by special conditions enumerated herein.
17. The road inmprovements for Rainbow Drive, Stelling Road
and Prospect Road shall be installed in conjunction with_
the first phase of the development. Upland Way
improvements shall be installed in conjunction with the
phase adjacent to Upland Way. Stelling Road shall be
dedicated as a 70 ft. right of way. Direct access from
the project to the residential area directly to the east
shall be prohibited. Appropriate medians shall be
constructed to provide right and left turns and to
prohibit direct access easterly across Stelling Road;
said `medians shall be installed as part of the first
phase of the development. The surplus right of way
shall be landscaped.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE APPROVAL OF A TENTATIVE MAP
WHEREAS , the attached application has been submitted to the City
of Cupertino requesting approval of a tentative map; and
WHEREAS , the Planning Commission has held at least one public hearing
in regard to the application; and
WHEREAS , the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS , the necessary public notices have been given as required
by the subdivision and procedural ordinances of the City of
Cupertino.
NOW, THEREFORE, BE IT RESOLVED :
1. That the Planning Commission makes the following findings :
a. That the proposed mapis consistent with the •

specific plans .
b. That the design or improvement of the proposed subdivision
is consistent with the general and specific plans .
c. That the site is physically suitable for the type of
development.
d. That the site is physically suitable for the proposed density
of development.
e . That the design of the subdivision or the proposed improvements
are not likely to cause substantial environmental damage or
substantially and avoidably injure fish or wildlife or their
habitat.
. f . That the design of the subdivision or the type of improvements
are not likely to cause serious public health problems .
g. That the design of the subdivision or the type of improvements
will not conflict with easements , acquired by the public at
large , for access through or use of , property within the pro-
posed subdivision.

18. The City Council shall approve a traffic control plan
for Rainbow Drive between Bubb Road and the Southern
Pacific Railroad right of way and a plan for
improvements to the intersection of Rainbow Drive and
Stelling ' Road prior to approval of a tentative
subdivision map for the project. The plan shall include
design elements to reduce vehicular speeds and traffic
volumes and discourage penetration into adjacent
neighborhoods. The plan may eliminate left turn
movements from the project onto Rainbow Drive.
The installation costs of improvements incorporated into
the plan shall be borne by the applicant. The plan
shall define the estimated maintenance costs and shall
define the obligation of the developer (future project
property owners) , the City and adjoining non-project
proeprty owners for maintenance of the street plan. The
plan must be submitted to the directly affected property
owners on Rainbow Drive for a vote before submittal of
said plan to City Council and the results submitted to
City Council with the plan.
19. The development shall be served by such water utility as
may be determined by the Cupertino City Council at the
hearing on the proposal for the tentative map.
20. The applicant is obligated to dedicate a fire station
411 site to the City. The site shall be located on the
southwest corner of Stelling Road and the Stelling Road
entrance to the project. The City Council shall make a
final decision regarding the size and means for funding
a subsequent building in conjunction with a subsequently
filed subdivision map request.

adjourned meeting of the Planning Commission of the City of
Cupertino, State of California, by the following roll-call vote:
