Reso 2612 2-TM-85 RESOLUTION NO. 2612 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO. • APPROVING A TENTATIVE PARCEL MAP TO CONSOLIDATE TWO PROPERTIES INTO ONE. APPLICANT: Kier & Wright Civil Engineers ADDRESS: 3350 Scott Boulevard, Bldg. 22, Santa Clara, California 95054 SUBMITTED: January 28, 1985 LOCATION: Southeast quadrant of Foothill Boulevard and Cupertino Road FINDINGS AND SUBCONCLUSIONS: Approval is subject to the findings as set forth on Page 1 and the subconclusions as set forth in the minutes of the Planning Commission meeting of March 11, 1985. CONDITIONS: 1-15. STANDARD CONDITIONS Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. • 16. APPROVED EXHIBITS That the recommendation of approval is based on Exhibit A of Application 2-TM-85 except as may be amended by special conditions enumerated herein. 17. FUTURE INGRESS/EGRESS EASEMENTS The applicant/property owner shall sign an agreement to participate in a reciprocal access easement with the adjoining property owner (s) to the south when said property owner(s) are obligated to participate in a similar agreement. The future easement shall be located in a manner which minimizes grade differences between the sites involved. 18. TREE PROTECTION The applicant shall provide a plan for preservation of the existing 30" Pine tree on the subject property. Said plan shall include a graphic description of protection devices to be installed along 'the dripline of said tree and which will remain for the duration of construction activities. The plan shall include an evaluation from a Landscape Architect outlining the effect of construction activity upon the tree and detailing measures to ensure its survival in accordance with Ordinance No. 778. 1 • • CITY OF CUPERTINO • City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A TENTATIVE PARCEL MAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative parcel map; and WHEREAS, the Planning Commission has held at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have 'been given as required by the subdivision and procedural ordinances of the ,City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 411 1. That the Planning Commission makes the following findings : a) That the proposed map is consistent with the general and specific plans. b) That the design or improvement of the proposed parcel map is consistent with the general and specific. plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the parcel map or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the parcel map or the type of improvements are not likely to cause serious public health problems. g) That the design of the parcel map or the type of improvements will not .conflict with easements, acquired by the public at large, for access through or 'use of, property within the proposed parcel. • • • 2-TM-85 Planning Commission Resolution No. 2612 (Continued) 19. FOOTHILL BOULEVARD CURB CUT The applicant shall remove the curb break on Foothill . Boulevard and replace it with vertical curbing and sidewalk area consistent with the remaining frontage on Foothill Boulevard.. 20. INGRESS/EGRESS EASEMENT An easement shall be obtained from the owner of "Lands of Jackson" to utilize a portion of said land for ingress and egress and parking consistent with the approved development plan for Application 13-U-84. The right of ingress and egress shall be extended to the . owner of the "Lands• of A.E.C. Electric" and "Lands of Preston".
