FINDINGS AND SUBCONCLUSIONS:

Approval is subject to the findings as set forth on Page 1 and
the subconclusions as set forth in the minutes of the Planning
Commission meeting of February 11 , 1985.
CONDITIONS:
1-15. STANDARD CONDITIONS
Standard Conditions to the extent that they do not
• conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special
conditions as enumerated herein shall apply.
16. APPROVED EXHIBITS
That the recommendation of approval is based on Exhibit
A of Application -Z-85 except as may be amended by
special conditions enumerated herein.
17. USE LIMITATIONS
If the property' s Floor Area Ratio does not exceed .25,
permitted uses shall include all uses allowed without
the securing of a use permit in the City of Cupertino CG
(General Commercial ) zoning district. If the property' s
Floor Area Ratio is between . 25 and . 33, permitted uses
shall include all uses allowed without the securing of a
use permit in the City' s OP (Planned Office) zoning
district. All uses requiring use permit review in a CG
or OP zone shall require use permit review in the •
subject Planned Development zone.
18. PUBLIC IMPROVEMENTS
411 The applicant shall be required to dedicate additional
right of way along De Anza Boulevard and relocate the
existing public improvements per the approval of the
Director of Public Works.

ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has, been submitted to the City of
Cupertino requesting a change of zone in 'the zoning regulations of the
• City, as stated on Page 2; and
WHEREAS the Planning Commission has "Iheld at least one public hearing
in regard to the application on the dateas noted on said application;
and
WHEREAS the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as required by
the:, Zoning .Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED: j
That the Planning Commission finds that the proposed zone change:
a) Encourages the most appropriateI,use of land,
b) Conserves and stabilizes the value of property,

c) Provides for adequate open spaces for light and air,
d) Permits adequate control of fires;
e) Promotes the health, safety and public welfare,

f) Provides for the orderly development of the City,
g) Is advantageous to the property$ and improvements in the zoning
district and neighborhood in which the property is located.
That said Planning Commission, therefore', reports favorably to the City
Council in the matter of granting said zone change.
