OF THE PLANNING COMMISSION OF THE CITY OF CUPERT I NO
RECOMMENDING APPROVAL OF AN AMENDMENT OF USE PERMIT
APPLICATION 14-U-82 TO MODIFY THE APPROVED MASTER SITE
• PLAN AND INCREASE THE BUILDING MAXIMUM PERMITTED FLOOR
AREA IN CONFORMANCE WITH THE GENERAL PLAN.

2. Condition 15 of Planning Commission Resolution No. 2357
is renumbered and reworded as follows: •
16. Approval is based upon Exhibits A, A--i. and B .of
Application 14-U-B2 (Revised) . The maximum amount
of permitted "occupied floor area" shall be
calculated by multiplying the parcel area by the
.33 Floor Area Ratio defined by the General Plan.
The "Area Calculations" table on Exhibit A- 1
defines the buildings/space which is defined as
unoccupied area.
3. Conditions 16-18 of Planning Commission Resolution No.
2357 are renumbered as 17-19.
4. A new Condition 20 is added .as follows:
20. The applicant shall complete the installation of
public sidewalks on all public street frontages for
the 96+ acre site. The sidewalks shall be
installed prior to occupancy of the next phase of
• development or within 2 years from date of
approval , which ever occurs first.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT
WHEREAS, the PlanningCommission
fission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a. That the use or uses are in conformance with the general plan
and is not detrimental to existing uses or to uses specifically
permitted in the zone in which the proposed use is to be located.
b. That the property involved is adequate in size and shape to
accommodate the proposed use.
c. That the proposed use will not generate a level of traffic
over and beyond that of the capacity of the existing street
system.
d. That the proposed use is otherwise not detrimental to the
health, safety, peace, morals andl generalwelfare of persons
residing or working in the neighborhood of such proposed use
nor injurious to property and improvements in the neighbor-
, hood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on:page .2; and
BE IT FURTHER RESOLVED:.
That the aforementioned findings be approved and adopted, and that the
