FINDINGS AND SUBCONCLUSIONS:
Approval is subject to th- findings as set forth on Page 1 and
the subconclusions as set forth in the minutes of the Planning
Commission meeting of August 3, 1984.
CONDITIONS:

1-15. STANDARD CONDITIONS
Standard Conditions to the extent that they do not
conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special
conditions as enumer-ted herein shall apply.
• 16. APPROVED EXHIBIT
That the recommendation of approval is based on Exhibit
A of Application 6-T -84 except as may be amended by
special conditions e umerated herein.
17. PRIVATE DRIVEWAY COV=NANT
The applicant hall record an appropriate deed
restriction and cove ant running with the land subject
to the review and ap■roval of the City Attorney, for all
parcels which shar= a common private drive or private
roadway with one or ore other parcels as displayed on
Exhibit A. Said dee. restriction shall provide for the
necessary ingress/=gress easements to and from the
affected parcels. Said easements shall be recorded at
such time as interes in one or more of the affected
parcels is initially sold or transferred to another
party.
18. ACCESS TO STEVENS CR=EK BOULEVARD
The applicant shall waive right of access to Stevens
Creek Boulevard as ■rovided by the State of California
Subdivision Map Act.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING
A TENTATIVE PARCEL MAP
WHEREAS, the attached application has been submitted to the City of Cupertino
requesting approval of a tentative parcel map; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application; and
WHEREAS, the Planning Commission has duly considered and heard all evidence
submitted in regard to said application; and
WHEREAS, the necessary public notices have' been given as required by the
subdivision and procedural ordinances of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:

1. That the Planning Commission makes the' following findings :
a) That the proposed map is consistent: with the general and specific plans.
b) That the design or improvement of the proposed parcel map is consistent
with the general and specific plans.
c) That the site is physically suitable for the type of development.
d) That the site is physically suitable for the proposed density of
development.
e) That the design of the parcel map or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
f) That the design of the parcel •map or the type of improvements are
not likely to cause serious public health problems.
g) That the design of the parcel map or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed parcel.

19. ROAD MAINTENANCE AGREEMENT
A reciprocal maintenance agreement to be reviewed and .
Sapproved by the City Attorney shall be required for all
parcels which share a common private drive or private
roadway with one or more other parcels within the
tract. Said agreement shall be recorded in conjunction
with recordation of the final map.
20. MINIMUM LOT SIZE
All lots shall equal a minimum lot area of 10,000 sq.
ft. Slight adjustments in the lot line locations may be
permitted to accommodate this requirement.
21. EXISTING STRUCTURE
The existing structure on parcel 1 shall be moved or
modified if any part of it is determined to be located
within the public right-of-way after Carmen Road is
surveyed for road improvements and dedication.
22. FIRE ACCESS
The through fire access lane shall be deleted and
replaced with a standard fire turn-around area located
between Parcels 2, 3, and 4, subject to review and
approval of the staff prior to recordation of the final
map. An emergency access easement shall be recorded over
said fire access and turn-around area.

• 23. PARKING
Parcels 3 & 4 shall provide a minimum of 4 functionally
independent off-street parking spaces per lot in
addition to required enclosed garage spaces.
24. SLOPE EASEMENT
The applicant shall record the slope easement adjacent
to Stevens Creek Boulevard.

meeting of the Planning Commission of the City of Cupertino,
