OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT AN
8,250 SQ. FT. OFFICE BUILDING.

FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and
the subconclusions as set forth in the minutes of the Planning
Commission meeting of September 10, 1984.
CONDITIONS:
1-15. Standard Conditions
Standard Conditions to the extent that they do not
conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special
110 conditions as enumerated herein shall apply.
16. Approved Exhibits
That the recommendation of approval is based on Exhibits
A, B, C and D of Application 14-U-84 except as may be
amended by special conditions enumerated herein.
17. INGRESS/EGRESS EASEMENT AGREEMENTS
The applicant shall record a covenant entering into a
reciprocal ingress/egress easement with the property to
the east subject to review and approval by the City
Attorney. If the adjoining property owner is not
willing to enter into reciprocal easements, the
applicant shall record a covenant agreeing to
participate in a reciprocal ingress/egress easement with
the adjoining property owner (s) when said property
owner (s) are obligated to participate in a similar
agreement.
18. PEDESTRIAN EASEMENT
Pedestrian easements over the sidewalk area located
outside the public right-of-way shall be prepared by the
410 applicant, reviewed by the City Attorney and recorded on
the subject property prior to issuance of building
permits.

19. CONSOLIDATE PARCELS
The applicant shall merge all existing parcels into a
single lot.
20. MODIFICATION OF THE APPROVED DEVELOPMENT PLAN
In the event that the applicant or subsequent property
owner shall desire to make any minor change, alteration
or amendment in the approved development plan or
building permit, a written request and revised
development plan or building permit shall be submitted
to the Director of Planning and Development. If the
Director makes a finding that the changes are minor and
do not affect the general appearance of the area or the
interests of owners of property within or adjoining the
development area, the Director may certify the change on
the revised plan. If such approval is witheld, the
applicant may appeal to the Planning Commission. If the
changes are material , the Director shall submit said
changes to the Planning Commission for approval . If the
change is denied by the Planning Commission, the
IIP applicant may appeal to the City Council as provided in
Ordinance 652 of the City of Cupertino. If the change
is approved, an appeal my be made by an interested
party. Further, any member of the City Council may
request a hearing before the City Council , said request
to be made within ten ( 10) days from the date of
approval - when the change has been approved by the
Planning Commission.
21 . Landscaping
The applicant shall add Coast Live Oak trees within the
landscape area in the parking lot. Additional Ginkgo
trees shall be planted behind the sidewalk along Stevens
Creek Boulevard and at the driveway entrance to Adriana
Avenue. The applicant may add grass turf within the
landscape area adjacent to the east property line and
the landscape area adjacent to the building and may add
seating areas within said area. All of the above
landscape modifications shall be subject to review and
approval by the staff at the building permit level .

22. Trash Enclosure
The refuge trash enclosure shall be relocated from the
north end of the parking lot to the north side of the 20
ft. wide landscape area adjacent to the east property
line.
23. Handicag ed Parking Stall
The handicapped parking stall shall be relocated to the
center of the project such that the widened section of
the parking stall aligns with the pedestrian entrance to
the building.
24. Acoustical Wall
The applicant shall be responsible for installation of
a 6 ft. high acoustical wall on the north side of
Adriana Avenue along the side yard of the adjacent
single family home. Additionally, the applicant shall
provide landscape screening on the street side of the
wall . Installation of the wall and landscaping is
subject to approval of the adjacent property owner and
staff prior to issuance ❑f building permits.
The applicant shall install an irrigation system and
shall maintain said landscaping area. A two foot wide
landscaping bed is desirable. If the staff , applicant,
and affected residential property owner can not reach a
reasonable agreement regarding a design, the matter
shall be returned to the Planning Commission as an
Unfinished Business Agenda Item.
25. Lighting
Parking lot lighting shall be consistent with the
standards contained on Page 24, Section 12b of the Monta
Vista Design Guidelines.
26. Street Improvements
The applicant shall be responsible for full improvement
of Adriana Avenue to connect with Mann Drive as
illustrated on Exhibit A. This will involve some off-
site improvements to ensure proper turning radius on the
north side of Adriana Avenue. Additionally, the
applicant shall be responsible for improvements to the
411 Mann Drive frontage and Stevens Creek Boulevard frontage
including undergrounding, etc. , as determined by the
City Engineer.
