OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW A
WEIGHT COUNSELING AND EXERCISE OPERATION TO OCCUPY
APPROXIMATELY 1 ,320 SQ. FT. WITHIN THE HOMESTEAD CENTER.

FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning
Commission meeting of September 10, 1984.
CONDITIONS:
1-15. Standard Conditions to the extent that they do not conflict
with the special conditions enumerated herein. In the
® event a conflict does exist, the special conditions as
enumerated herein shall apply.
16. The approval is based upon Exhibits A and A-1 of
Application 16-U-84 as may be amended by additional
conditions contained herein.
17. The subject use permit is conditioned upon the continued
viability of the reciprocal parking agreement recorded in
the records of Santa Clara County, June 16, i975$ #5030702.
Should said agreement be revoked, cancelled or declared
void for any reason, the use permit ' may be subject to
review and amendment.
18. Public access may be provided through the rear door so as
to encourage utilization of the parking lot located at the
easterly side of the building.
19. The applicant/tenant shall encourage employees to park in
the easterly parking lot to the rear of the building.
20. The evening hours of operation (past 6:00 p.m. ) may be.
curtailed if parking demand exceeds supply. The Planning
Commission may informally evaluate the parking situation
and modify hours accordingly, as an Unfinished Business
Agenda item. The Commission 's decision may be appealed to
the City Council as provided in Ordinance 652.

RESOLUTION OF THE PLANNING COMMISSION, OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT
WHEREAS , the Planning Commission of the City of Cupertino received
an application for a USE PERMIT, as stated on Page 2 ; and
WHEREAS , the applicant has met the urden of proof required to
support said application; and
WHEREAS , the Planning Commission finds that. the application meets

the 'following requirements :
a. That the use or uses are in conformance with the general l
plan and is not detrimental to existing uses or to uses
specifically permitted in 61e zone in which the proposed
use is to be located .
b. That the property involved is adequate in size and shape
to accommodate the proposed use.
c. That the proposed use will not generate a level of traffic •
over and beyond that of th' capacity of the existing street
system.
d . That the proposed use is o herwise not detrimental to the
health, safety, peace , morels and general welfare of persons
residing or working in the neighborhood of such proposed use
nor injurious to property nd improvements in the neighbor-
hood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps , facts , exhibits and other
evidence submitted in this matter , the application of the USE PERMIT
is hereby recommended for approval , subject to the conditions stated
on Page 2 ; and -

BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted , and that
the. Secretary be , and is hereby directed to notify the parties
affected by this decision.
