Reso 2575 4-U-83 • RESOLUTION NO. 2575 111 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A MINOR AMENDMENT TO USE PERMIT 4-U-83 APPLICANT: Carl N. Swenson (Itsuo Uenaka) ADDRESS: 95 S. Market Street, San Jose, California 95113 SUBMITTED: February 1, 1983 LOCATION: West side of North De Anza Boulevard approximately 200 ft. south of Mariani Avenue 1. The minor amendment modifies Condition 18 setting forth the TRIP and FAR credit accounting for the project. Condition 18 of Application 4-U-83 is redrafted as follows: CONDITION 18 18. The approval of the construction of the 75,000+ gross sq. ft. of building area is contingent upon the transfer of trips or floor area ratio credits (development rights) from other sites. The applicant shall be required to record a covenant on the transferring sites to reflect the reduction of trips or floor area ratio credits available prior to issuance of building permits for the subject structure. S . The land use intensity shall be limited' to an intensity that will not generate more than 16 one-way trips per acre during the peak traffic hour or such other traffic constraints as imposed by the current General Plan. For the purpose of the 16 one-way trip Traffic Intensity Performance Standards, the accounting of trips is defined by the attached Table One dated October 13, 1984 which is hereby incorporated into the project approval . All sales or transfer of trips or FAR credits must be filed with the Planning Director and City Clerk. No sale or transfer shall be finally consummated until a Use Permit amendment has been approved for the property to which the trips are to be applied. The applicant shall record a covenant to describe the trip acre constraint and the total number of trips allocated to the particular development.
