Fazekas Passed 4-0 WRITTEN COMMUNICATIONS: Diane Mignardot Rylan Luke PLANNING COMMISSION MINUTES Regular Meeting of June 25, 1990 Page 2 ORAL COMMUNICATIONS: Ms. Catherine Nickerson, representing concern citizens around st. Andrews Church, who submitted a petition to Planning Commission and City council. She suggested a hearing be held on July 23, 1990 regarding the review of the use permit for the church. Mr. Cowan stated that City Council had directed him to prepare correspondence as to the city's position on this matter. He felt at this time it was not necessary to hold a hearing. He noted he is researching the matter. CONSENT CALENDAR: - None PUBLIC HEARINGS: 1. Application No(s): Applicant: Property Owner: Location: 3-Z-90, 5-TM-90 and ll-EA-90 First Baptist Church of Monta vista Same North side of McClellan Road, 130 ft. west of Byrne Avenue REZONING of approximately 2.07 acres from BQ (Quasi Public Building) to Rl-7.5 (Single Family Residential, 7,500 s.f. min. lot area) or such other zoning classification as deemed appropriate by the Planning Commission or city Council. TENTATIVE MAP to subdivide 2.07 acres into nine lots ranging· in size from 7.600 s.f. to 10,300 s.f. Staff Presentation: Ms. Michele Bjurman presented the staff report. She noted the applicant had prepared an alternate subdivision to what was originally proposed. Ms. Bjurman showed a diagram of the new plan. She stated the revised plan reflects conservation easements on lots 1, 2, 3 and 6 and stated fencing and decks will be allowed in the easement areas, but construction would not. In response to Com. Fazekas question Ms. Bjurman stated the driveways on the revised plan are adequate. ADDlicant Presentation: Mr. Ken Rounsaville, Bay Area Consultants, spoke in favor of the staff report and noted either proposal would be acceptable. He noted he had no objections to shortening the cul-de-sac and either the conservation easement or private covenant option would be acceptable. Com. Mackenzie stated he was in favor of the original plan. Com. Fazekas spoke in favor of the revised plan stating there was now more room to build on some of the lots. Mr. Rylan Luke expressed concern regarding the traffic issue, he suggested stop signs on McClellan where the access could come out. He commented on the public hearing process, stating it works. He spoke in support of the access from McClellan and expressed concern regarding the preservation of the trees. He noted the issue of condemnation of the Yuen land is an issue and suggested that construction of the property be delayed until the city Council has a hearing. Mr. Ken Philips, San Fernando Ave., stated that the access from San Fernando is dangerous because of the storm drain. He stated that the traffic would increase by 50 percent with the development and expressed concern regarding pedestrian traffic. Mr. Philips showed a diagram of the original plan of the area pointing out where a retaining wall should go. He went on to explain the access issues at McClellan. He suggested a 4 way stop sign at the turn on McClellan and also suggested a PD zoning with an access onto McClellan. Mr. Tim Yuen, 10445 San Fernando, noted the conservation easements proposed were not large enough. He expressed concern regarding the preservation of the trees and stated the conservation easements were not adequate. He spoke in support of access onto McClellan and urged the Commissioners to support this. He noted that another church may be interested in buying the property. Ms. Laura Donn Commissioners. McClellan. presented a petition with 20 signatures to the She noted they were opposed to access onto Mr. Anthony Scionti, San Fernando Ave., spoke in support of access on to McClellan and expressed concern regarding existing access from Byrne to McClellan and suggested stop signs. Mr. Scionti expressed concern regarding the preservation of the trees. Mr. clayton Stokes, applicant, stated that it is dangerous and difficult entering the church property from McClellan. He explained the different options of getting onto McClellan with access from the development onto San Fernando Ave. Mr. Barrie Coate, Arborist, explained tree preservation measures to be taken for the soil grade. He noted the buildings could be built above the existing grade. He stated that the trees will be in better condition when the development is completed. In response to Com. Adams question Mr. Coate stated he agreed with staff report. In response to Com. Fazekas question Mr. Coate stated that it would not make any difference as to the decks being built with the development or later as long as all the requirements are followed to preserve the trees. PLANNING COMMISSION MINUTES Regular Meeting of June 25, 1990 Page 4 In response to Com. Mann's question regarding utility workers, Mr. Coate stated they will be monitored. MOTION: SECOND: VOTE: Com. Adams moved to close the public hearing Com. Fazekas Passed 4-0 Corns. Mann, Adams and Fazekas spoke in favor of the San Fernando access. Com. Adams suggest stop signs on McClellan at a later time. In response to this Travis Whitten, Public Works stated where the stop signs are required there is a private entrance and stop signs are not warranted. He noted there were resources in CAP for 1992-93 for improvements on McClellan between Byrne and Linda vista. Com. Fazekas stated he would like to see street widening on San Fernando. Com. Fazekas stated he would support the conservation easements as they protect the individual trees and would like to see decks around the trees. Com. Mann, Com. Mackenzie and Com. Adams concurred with Com. Fazekas. Coms. Mann, Adams and Fazekas supported shortening the cuI de sac. Com. Mackenzie expressed lack of parking if this was enforced. Ms. Bjurman explained the off site parking requirements. Com. Mann suggested a pedestrian access onto McClellan. Mr. whitten stated as a condition of approval the subdivision would be responsible for the widening of San Fernando. Mr. Bob Cowan stated it was not appropriate to have a parking condition on the tentative map and suggested having the provision for four off site parking spaces. Mr. Cowan added a condition regarding this as outlined in the motion. After a discussion on parking it was agreed by the Commissioners that two guest parking spaces off site would be adequate, to be commonly shared. The Commissioners reworded certain conditions in the staff report as outlined in the motion. The Commissioners discussed decking, Mr. Coate stated 13 ft. from the tree would be adequate for decking. Com. Adams suggested 10 to 15 ft. to be worked out between staff and the arborist. MOTION: SECOND: VOTE: MOTION: SECOND: VOTE: Com. Fazekas moved to recommend granting a Negative Declaration Com. Mann Passed to send a report to council of 3-Z-90 per staff report 4-0 PLANNING COMMISSION MINUTES Regular Meeting of June 25, 1990 Page 5 MOTION: SECOND: VOTE: Com. Fazekas moved to recommend approval for 5-TM-90 subject to the findings and subconclusions of the hearing with the following modifications: Cond 1. widening of San Fernando to the satisfaction of the city Engineer; Condo 20 (b) to add the words - All public utility companies should not be allowed to trench or to place overhead wires in the designated easement area. The final tentative map shall reflect a "right of reasonable access" for inspection purposes by city staff; Condo 20(d) section 4 to be added: At the precise development stage decking must be outlined on the plan to protect the trees and this decking shall be a minimum of 10 to 15 ft. from each of the protected tree trunks and must extend at least to the end of the tree canopies and the exact amount of space between the trunk and the decking shall be determined by staff and a certified arborist but it cannot be less than a third of the total tree canopy tree area; Condo 23 to read the applicant shall record a reciprocal driveway and common parking easement, the driveway should be 18 ft. wide and show two parking spaces. The easement shall involve a maintenance provisions and should be approved by the City Attorney. Com. Adams Passed 4-0 NEW BUSINESS: 5. APPLICATION 4-U-86 (REVISED) : CITY CENTER ASSOCIATES (prometheus Development Co.): Request to extend the prescribed period for installation of park area landscaping and improvements for an additional six months. The park area is located on that portion of the City Center site immediately adjoining the southeast corner of De Anza and Stevens Creek Boulevards. Staff Presentation: Mr. Mark Caughey presented the staff report. He referred to the City Clerk's letter of 1987 which contains a condition for the developer to provide improvements within one year of occupancy of the office buildings. He noted the developers request is to extend the period from 12 months to 18 months. Mr. Caughey noted that it would be at least a year before any significant changes were seen in this area. In response to Com. Adams question Mr. Caughey stated that a 6 month extension is adequate. Aoolicant Presentation: Mr. Walter Hsu presented background on this development. In response to Com. Mackenzie's question Mr. Hsu stated they had hired a consultant to improve the landscaping which had been submitted to staff. PLANNING COMMISSION MINUTES Regular Meeting of June 25, 1990 Page 6 Mr. Bob Cowan stated that staff had requested Prometheus to delay the installation of trees and will hire a consultant for a better solution to the trees. The public hearing was then opened. Mr. Farokh Deboo, 10257 Nile, stated the General Center was for a very intense development plan. not against the extension, but stated it expeditiously. Plan for the City He noted he was should be done Mr. Bob Cowan clarified that the park is totally landscaped stating there is no obligation to plant trees in front of the hotel. He noted this condition only pertains to the turf area. Com. Mann suggested a nine month extension. Com. Mann and Com. Fazekas supported staff's recommendation. MOTION: SECOND: VOTE: Com.
