Approval is subject to the findings as set forth on Page 1 and
subconclusions as set forth in the Minutes of the Planning
Commission meeting of February 13, 1994.
CONDITIONS:
Approval is based upon the Conditions of Approval enumerated in
Planning Commission Resolution No. 2468 subject to the following
amendments to Conditions 15, 16 17,18 and 22.
15. The approval is based upon Exhibit A 2nd Revision of
Application 20-TM-93 (Revised) as may be amended by
additional conditions contained herein.

? "S. Area Wide Im rovements
The applicant/property owner shall participate in his
proportionate share of major off -site street improvements
of a local or communitywide nature, as identified in the
General Plan, by paying the construction tax in effect at
the time of occupancy. Should the construction tax be
deemed inappropriate, the applicant shall satisfy the
obligation by utilization of any of the following methods.
1. Funded directly.
� . Funded through an assessment district.
�. Any other method deemed appropriate by the City
Council.
1717. Below Market Rate Housin Pro ram
The applicant shall participate in the City's Below Market
Pate Housing Program. The applicant shall record a
covenant restricting sales price, resale procedures, etc.
per the requirements of the City's Below Market Rate
Housing Program. Said covenant shall be recorded
simultaneously with the filing of the final subdivision
map for each unit of the residential development and shall
be subject to review and approval of the City Attorney.

meeting of the Planning Commission of the City of Cupertino, State
