RESOLUTION NO. 2492 (Minute Order)
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
FORWARDING A RECOMMENDATION TO THE CITY COUNCIL REGARDING
THE EXERCISE OF GREATER CONTROL OVER DRINKING ESTABLISHMENTS
AND OTHER ACTIVITIES WHICH CAN POTENTIALLY CREATE NUISANCE
PROBLEMS FOR ADJOINING PROPERTY OWNERS.
The Planning Commission determined that Cupertino citizens
including merchants should receive information defining how
complaints can be filed with the City or other agencies that
exercise some degree of control over specific activities. The
article could outline typical nuisance problems and how they can
be resolved and by whom and when.
The Planning Commission also determined that the City Council
should authorize the Planning Commission to conduct a hearing 'to
amend the Non -Conforming Use Ordinance to provide abatement
periods for illegal non -conforming activities. For example, the
Planning Commission could consider an abatement procedure for
certain activities that require use permits to obtain a use
permit over a certain period of time.
PASSED AND ADOPTED this 14th day of March, 1994, at a regular
meeting of the Planning Commission of the City of Cupertino,
State of California, by the following roll call vote:
