RESOLUTION NO. 2496
OF THE PLANNING COMMISSION OF
THE CITY OF CUPERTINO RECOMMENDING
APPROVAL OF A MODIFICATION OF A USE PERMIT
6-U-73 (REVISED) (VALLCO FASHION PARK) TO
CONSTRUCT A THREE LEVEL PARKING STRUCTURE ON
THE WEST SIDE OF THE CENTER SITE.

Creek'Boulevard and State Highway 290
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on
the Page 1 and subconclusions as set forth in the minutes of the
Planning Commission meeting of April 9, 1984.
1-14. Standard Conditions to the extent that they do not
conflict with the special conditions contained herein.
In the event a conflict does exist, the special
conditions as enumerated herein shall apply.
15. The Conditions contained herein are compended to
previous conditions of approval for the Regional
Shopping Center 6-U-73.
16. The approval is based upon Exhibits A-2 and G of
Application 6-U-73 (Revised) as may be modified by
additional conditions contained herein.
17. The striping plan for the parking structure shall be in
accordance with the approved parking stall dimensions
for Vallco Fashion Park or dimensions authorized by City
ordinance. The City staff is authorized to approve the
striping plan.
18. The lighting fixtures for the upper most deck shall be
no higher than existing lighting fixtures located on the
surface lot. The lighting fixtures shall be shielded to
prevent a light source from directly entering adjoining
residential properties.

WHEREAS, the Planning Commission If the City

Plan and is not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed
use is to be located.
b. That the property involved is adequate in size and shape tc•
accommodate the proposedl' use.
C. That the proposed use will not generate a level of traffic
over and beyond that of.the capacity of the existing street
system.
d. That the proposed use is!otherwise not detrimental to the
health, safety, peace, morals and general welfare of persons
residing or working in the neighborhood of such proposed
use nor injurious to property and improvements in the
neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration iof maps, facts, exhibits and other
evidence submitted in this matterl, the application of the USE PERMIT
be, and the same is hereby granted, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned fidnings Abe approved and adopted, and that
the: Secretary be, and is hereby directed to notify the parties affected
by this decision.

19. The perimeter road landscaping shall be augmented where
necessary to visually screen the structure from the
adjoining residential neighborhood. City staff shall
approve the landscaping plan.
20. The City staff has the authority to approve minor
architectural changes to the structure to accommodate
additional pedestrian access for fire fighters.
21. Vallco Park shall maintain adequate security for the
garage. The City staff, upon consultation with the
Sheriff's Department, shall determine the adequacy of
protection.
22. The "haul" route for excavated earth shall be Vallco
Parkway, east to Wolfe Road.
23. If the City receives complaints or otherwise determines
that noise problems exist within the structure during
is non -shopping hours, the City reserves the right to
conduct a public hearing to consider a remedy(ies) to
resolve the problem.

meeting of the Planning Commission of the City of Cupertino,
