OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF PLANNED DEVELOPMENT ZONES FOR
PORTIONS OF OLD MONTA VISTA.

LOCATION: Generally bounded by Granada.Avenue to the north,
Imperial Avenue to the east, McClellan Road to the
south and by the westerly boundary of the Blackberry
Farm Golf Course to the west.
This document and its accompanying zoning sketch map contains a
recommendation to prezone and rezone specific areas consistent
with the Cupertino General Plan.
A. Exhibit A 1st Revision Zoning Map: Areas D, E, I, and J
(Imperial Avenue)
CONDITIONS_ OF APPROVAL
1-14. Standard Conditions to the extent that they d❑ not
conflict with the special conditions enumerated
herein. In the event a conflict does exist, the
special conditions as enumerated herein shall apply.
15. The approval is based upon the zoning descriptions
contained within the legend of Exhibit A i st Revision
of Application 1-Z-84 as may be amended by additional
conditions -contained herein.
16. The land use types, land use intensity and the
circulation planning within Areas D, E, I and J shall
reflect the adopted Specific Plan for Old Monta Vista
labeled "Stevens Creek Boulevard Plan Line Action
Plan".
17. Existing residential dwellings can be remodeled and
expanded. New dwellings can be constructed if said
development can be designed in a manner which will
create a living environment reasonably free from
obtrusive elements normally associated with industrial
developments.

ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has been submitted to the City of
Cupertino requesting a change of zone in the zoning regulations of the
City, as stated on Page 2; and
WHEREAS -the Planning Commission has held at least one public hearing
in regard to the application on the date as noted on said application;
and
WHEREAS the Planning Commission has,duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as required by
the Zoning,Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a) Encourages the most appropriate use of land,
b)
Conserves and
stabilizes the value of
property,
c)
Provides for
adequate open spaces for
light and air,
d) Permits adequate control of fires,
e) Promotes the health, safety and public welfare,
f) Provides for the orderly development of the City,
g) Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located.
That said Planning Commission, therefore, reports favorably to the City
Council in the matter of granting said zone change.

In the event a residential structure existing at the
time this Ordinance becomes effective, is destroyed
due to fire or other natural phenomenon, it may be
replaced to the extent that the foundation lines that
previously existed are substantially the same.
18. All permitted uses described in the City's ML (Light
Industrial) zoning district are permitted uses except
that automotive repair businesses must obtain use
permit approval to operate. Use permits shall be
required for new construction and for those
activities, including auto repair activities, which
require use permit approval in a conventional ML zone.

(Pasadena Avenue)

1-14. Standard Conditions to the extent that they do not
conflict with the special conditions enumerated
herein. In the event a conflict does exist, the
special conditions as enumerated herein shall apply.
15. The approval is based upon the zoning descriptions

of Application 1-Z-84 as may be amended by additional
conditions contained herein.
16. The land use types, land use intensity and the
circulation planning within Areas A, B, C, G, and H
shall reflect the adopted Specific Plan for Old Monta
Vista labeled "Stevens Creek Boulevard Plan Line
Action Plan".
17. Due to existing lot sizes' and/or structure location,
there are no specific zoning requirements relative to
setbacks, lot coverage and parking with the exception
of the requirement set forth in the Uniform Building
Code. It is inten(ied that the requirements of the
zone (R1, R2 and R3) in which the use is ordinarily
permitted will be strived for, however, the City, as a
part of the use permit procedure, may establish lesser
setbacks, greater lot coverage and lesser parking
requirements as it deems appropriate.
In the event, an applicant's proposal is in keeping
with the requirements of the zone in which the use is
ordinarily permitted, excepting lot sizes, the
Planning Director shall have the ability to approve
®� the plans, and the use permit procedure will not be
necessary.

15. The approval is based upon the zoning descriptions
contained within the legend of Exhibit A 1st Revision
40 of Application 1-Z-84 as may be amended by additional
conditions contained herein.
16. The land use types, land use intensity and the
circulation planning within Area k shall reflect the
adopted Specific Plan for Old Monta Vista labeled
"Stevens Creek Boulevard Plan Line Action Plan".
17. Due to existing lot sizes and/or structure location,
there are no specific zoning requirements relative to

Single-family dwellings are preferred for projects
which are of a density of 7 dwelling units per acre or
less. .

herein. In the event a conflict does exist, the
special conditions as enumerated herein shall apply.
15. The approval is based upon the zoning descriptions
contained within the legend of Exhibit A 1st Revision
of Application 1-Z-84 as may be amended by additional
conditions contained herein.
16. Land uses shall be limited to those defined in the
A-ua zoning district. All land use activity and all
new construction shall be subject to use permit review
as required by the Planned Development Zoning
Ordinance.

meeting of the Planning Commission of the City of Cupertino,
