SECTION I.- FINDINGS
W M:ZFM,, the Planning Commission of the City of Cupertino receive an
application for a `Tentative Subdivision Map, as described on Page 2 of
this Resolution; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and Procedural Ordinances of the City of Cupertino,, and the
Planning Commission has held at least one Public Hearing in regard to the
application; and
WIa the Planning Commission finds that the application meets the
following requirements.
a) That the proposes subdivision map is consistent with. the City of
Cupertino General Plan and any applicable Specific Plana
b) That the design or improvement of the proposed division is
consistent with the General Plana and any applicable Specific
Plana
c) That the site is physically suitable for the type and intensity
of development contemplated under the approved subdivision.
d) That the design of the subdivision or the proposed improvements
are not likely are not likely to cause substantial environmental
damage nor substantially and avoidably injure fish and wildlife
or their habitat.
e) That the design of the subdivision or the type of improvements
associated therewith are not detrimental to the healthi safety,
peace, morals and general welfare of persons residing or working
in the vicinity of the subdivision.
f) That the design of the subdivision and its associated
improvements will not conflict. with easements acquired by the
public at large for access through or use of property within the
proposed subdivision.
That upon careful consideration of maps, exhibitsr facts, testimony and
other evidence omitted in this matter, the application for Tentative
Subdivision Pap is herd recommended fora. approval, subject to the
conditions enumerated in this Resolution beginning on Page 2'thereof o and

That the subconclusions upon which the findings and conditions specified
in this Resolution are based are contained in the Public Hearing Record.

SECTION III: CONDITIONS AD=STERED BY THE PUBLIC WORKS DEPARMTo
1. STREET WIDENING
Street widening, improvements and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer. The developer shall be responsible for the
development of a half sheet plus 10 feet between the westerly boundary
of the subdivision and Blaney Avenue. The request includes the
acquisition of right -of -ray.
Curbs and cutters, sidewalks and relate structures shall be installed
an accordance with grades and standards as specified by the City
Engineer.
Street lighting shall be installed and shall be as approved by the
City Engineer. Lighting; fixtures shall be positioned so as to
preclude glare and other forms of visual interference to adjoining
properties, and shall be no higher than the maximum height permitted
by the zone in which the site is located.
Fire hydrants shall be locate as required by the City.
5. TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the
City:'
6. STREET TREES
Street trees shall be planted within the Public Right of Way and shall
be of a type approve by the City in accordance with ordinance 125.

Graff shall be as approved and required by the City Engines an

Drainage shall be provided to the satisfaction of the City Engineer.
Surface flow across public sidewalks may be allowed an the R 1, R®2
and R-3 zones unless storm drain facilities are deemed necessary by
the City Engineer. Development in all other zoning districts shall be
served by on site storm _drainage, facilities connected to the City
storm drainage system. If City storm drains are not available,
drainage facilities shall be installed to the satisfaction of the City
Engineer.

The developer shall comply with the requirements of the Underground
Utilities ordinance No. 331 and other related Ordinances and
regulations of the City ,of Gino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall sulmit detailed plate showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.
The project developer shall enter into a development agreement with
the City ;of Cupertino providing for payment of fees, including hat not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for undergrounding of utilities. Said
agreement shall be executed prior to issuance of construction permits-

Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping
or located underground such that said equipment is not visible from
public street areas.

12. APPROVED FITS
The recordation of approval is based on tentative map exhibit of
10--9M-89, except as may be amended by the Conditions contained in this
Resolution.

13o MODIFICATION OF APPROVED DEVELOPMENT PLAIT
In the event that the applicant or subsequent property owner shall
desire to make any minor charges, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the charges are minor do not
result. in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approvaI of said changes is withheld, the applicant nay appeal to the
Planning Canunissiono
If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Commission for approval. If
the charges are denied by the Planning commission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may
be made -to the City Council by any interested party. Further, any
Member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said changes by the
Planning Commission.
14. TREE PROTECTION
The applicant shall provide a plan for preservation of the indicated
specimen trees on the subject property. Said plan shall include
graphic depiction of protection devices to be installed along the
dripline perimeter of each tree for the duration of construction
activities.
15. DEMOLITION RFQU\FI'
All existing structures on the site shall be removed prior to or
concurrently with project construction. The developer shall assume
the responsibility to obtain all required demolition permits in
accordance with City Ordinances.
16. FLAG CORRIDOR
The flag driveway corridor serving Lot 16 shall be shifted from
Rodrigues Avenue to Price Avenue. The driveway shall be located
between lot 1 and 20
17. MU Mf7M LOT SIZE FOR LOTS 17 AND 18
The minimum lot size of Lots 17 and 18 shall be 6,750 sq. ft.
