SECTION _I: FINDINGS
the Planning comnission of the City of Cupertino received an
application for a Tentative Subdivision Map, as descries on Page 2 of
this Resolution; and
WAS, the necessary public notices have been given as required by the
subdivision and Procedural Ordinances of the City of Cupertino, and the
Planning Ccmmission has held at least one Pudic Hearer in regard to the
application; and
*MZEAS, the Planning omission finds that the application rots the
following requirenvents o
a) That, the proms subdivision map is consistent with the City of
Cupertino General Plan and any applicable Specific Plano
b) That the design or improvement of the proposed, subdivision is
consistent with the General Plan and any applicable Specific
Plano
c) That the site is physically suitable for the type and intensity
of development contlated under the approved subdivision.
d) That the design of the subdivision or the Proposed iuVrovMlents
are not likely are not likely to cause substantial envirormental
damage nor substantially and avoidably injure fish and wildlife
or their habitat.
e) That the design of the subdivision or the type of ,anprovements
associated therewith are riot detrimental to the health, safety,
peace, gals and general welfare of persons residing or working
in the vicinity of the subdivision.
f) That the design of, the subdivision and its associated
aprovenents will not conflict with easements acquired by the
public at large for amass through or use of property within tie
proper subdivision;
NOW; THEREFORE9 BE IT RESOLVED:
That upon careful consideration of"maps, exhibits, facts, testimony and
other ev dence sulmittedin this matter, the application for Tentative
Subdivision Map is hereby reammended for approval, subject to the
conditions emmierated in this Resolution beginning on Page 2 thereof; and

That the subconclusions upon which the findings and conditions specified
in this Resolution are based are contained in the Public Hearing Record
concerning Application 11 89 as set forth in the Minutes of the
planning camiission Meeting of September 11g 1989, and are incorporated by
reference as though fully set form herein.

Street widening,, improvements and dedications shall be provided in
accordance with City Standards and specifications and , as required by
the City Engineer.
2. CURB AND
Curbs and gutters, sidewalks and related structures shall be installed
in accordanoe with grades and s as specified by the City
Engineer.
Street lighter shall be installed and shall be as approved by the
City Engineer. Lighting fixtures shall be positioned so- as to
preclude glare and other form of visual interference to adjoining
properties, - and shall be no higher than the min► height permitted
by the zone in which the site is located.
4. FIRE HYDRANT
Fire hydrants shall be located as required by the City.
5. 'TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the
city.

Grading shall be as approved rewired bar the City in

Drainage shall be provided to the satisfaction of the City Engineer.
Surface flow across public sidewalks may be allowed in the R 1, R 2
and R 3 zones unless` storm drain facilities are deemed necessary by
the City'Engineer. bevel t in all other zoning districts shall be
served by on site storm drainage facilities �nnectsd to the City
stow drai nags systAm. If City storm drains are not available,
drainage facilities shall be installed to the satisfaction of the City
Engineer.
The developer shall couply with the requirements of the Underground
Utilities ordirkmce No. 331and other relate Ordinances and
regulations of the City of cupertino,, and shall coordinate with
affected utility prodders for installation of underground utility
devices. The developer shall °t details plans showing utility
underground provisions. said plans shall be eject to prior approval
of the affected Utility provider and the City Enginee.

The rec=endation of approval is based on Mddbit 1 of Application
11 890 except as ray be amended by the Conditions contained in this
Resolution.
The project developer small enter into a development agreement with
the City of Cupertino providing for payment of fees,, i.ncl but not
limited to cheoking arm inspection fees,, storm dram fees, park
dedication fees and fees for undergrounding of utilities. Said
agreement ` shall be executed prior to issuance of construction permits

The applicant shall record an appropriate deed restriction and
covenant running with the land for all parcels which share a ccmwn
driveway or private roadway with one or more other parcels as depicted
on Exhibit of this application. Said deed restriction shall pride
for necessary reciprocalingress/egress easements to and from the
affected parcels. Said easements shall be recorded at such time as
interest in one or more of the affected parcels is initially sold or
transfexred to another

A reciprocal maintenance agreement shall be, required for all parcels

conjunction with recordation of the final map, and shall subject to
prior approval as to form and content by the City Attorney-

13o DEDICATION OF
The developer shall dedicate to the City all waterlines and
appurtenances installed to City Standards and shall reach an agreement
with SanJose Water Works for water service to the subject
development.
14. DqGRESSIBMRESS EASENEUS
The applicant shall record an appropriate deed restriction and
covenant with the land subject to approval of the City
Attorney®' for all parcels which share a common private drive or
private roadway with one or re:other parcels. Said deed restriction
shall provide for necessary reciprocal ingress and egress easement to
and from the affected also Said easements shall be recorded at
such time as interest in one or more of the affected parcels is
initially sold or transferred to another partyo
15. FIRE ASS IANES
Emergency fire ads lanes shall be recorded as fire lane easements
on the final map and shall meet Central Fire District standards.
16. HOMEOWNERS ASSOCIATION DOT'S
The Hoxaeowners Association documents, enabling declaration and
condaminium plan shall be approved by the Department of Ply and
Development and by the City Attorney prior to recordation.
