APPROVING A TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY
18 NET ACRES IM ONE PARCEL
SECTION FINDINGS
WHEREAS, the Planning Coamnissiorn of the City of Cupertino received an
application for a Tentative Subdivision Map, as described on Page 2 of
this Resolution; and
WEB, the necessary public notices have been given as regL=ed by the
subdivision and Procedural Ordinances of the City of Cupertino, and the
Planning Conmission has held at least one Public Hearing in regard to the
application® and
2EAS, the Ply commission finds that the application meets the
following requirements:
a) That the proposed subdivision map is consistent with the City of
Cupertino General Plan and any applicable Specific Plan.
b) That the design: or improve ,ent of the proposed subdivision is
consistent with the General 'Plan and any applicable Specific Plano
c) That the site is physically suitable for the typo and intensity of
development contemplated mere the approved subdivision.
d) 'zhat the design of the subdivision or the proposed improvements are
not likely are not likely to cAuse substantial envigormental damage
nor substantially and avoidably injure fish and wildlife or their
habitat.
e) That the design of the subdivision or the type of improvements
associate therewith are not detrimental to the health® safety,
peace, morals and general welfare of persons residing or working in
the +vicinity of the subdivision.
f) That the design of the subdivision and its associated improvements
will not conflict with easements acquired by the public at ,large for
access through or use of property within the proposed subdivision.
That upon careful consideration of maps, exhibits, facts' testimony and
other evidence submitted in this matter, the application for Tentative.
Subdivision Map is hereby reomnended for approval, subject to the
conditions enumerated in this Resolution beginning on Page 2 thereofa and

in this. Resolution are are.contained in the Public Hearing Record
concerning Appli Lion 10 [ 88, as set forth in the Minutes of the
Planner Ccmnission Meeting of Novi 14, 1988, and are incorporated by
reference as though fully set forth herein.

1. S'TREE°1' IMPROVEMUS & DEDICATION
Street widening, improvements, and dedications shall be in accordance
with City Standards and specifications and as required by the City
Engineer.
Curb and gutters, sidewalks and related structures shall be installed
in accordance with graces and stems as specified by the City
Engineer.
3. LIGHnNG
Street lighting fixtures shall be installed as directed. by the City
Engineer. All on and off -site lighting shall be designed to in no way
interfere with adjacent areas and shall be no higher than the utaxuam
height permitted by the zone in which the property is located.
4. FIRE HYDRANT
Fire hydrants shall be locate as required by the City.
5. TRAFFIC CONTROL SIGNS
Traffic control signs shall be placed at locations specified by the
City.
Street try shall be planted within the Public Right of Way and shall
be of a type approved by the City in accordance with ordinance 125.
7. GRADING
Graff shall be as approve and required by the City Engineer in
accord with Ordinance 2141(a).

8 0 DRAINAGE
Drainage shall be provided to the satisfaction of the City Erngineer.
The applicant shall be responsible for Implying with the requirements
of the Underground Utility Ordinance No. 331 and other related
ordinances and regulations s of the City of Cupertino, and shall make
the necessary arrangements with the utility canes involved for the
installation of said facilities. The applicant shall suhmit a
detailed plan showing utility underground provisions. (This plan must
have prior approval of the utility ompanies and the City Engineer.)
The applicant shall be responsible for completing the site as shoes on
approved plot plan and shall be required to enter into an improvement
agrt with the City of Ct4xextino providing for payment of
necessary fees, including but not limited to checking and inspection
fees, storm drain fee, and underground utility fee. Said agreement
shall be executed prior to the issuance of a building permit.
11. TRANSFOMR SCREENING
Electrical and telephone transforMers shall be SCreened with fencing
and landscaping, or undexgr6undedj such that they are not visible from
public street areas.
12. SEISMIC AND GBOYAGIC BZARDS
The applicant shall retain an engineering geologist to evaluate and
mitigate potential seismic and geologic hazards. Said geologic
investigation shall be Meted prior to release of building permits.
13. DEDICATION OF Yn1=
The developer shall dedicate to the City all waterlines and
appurtenances installed to City Standards and shall reach an agreement
with the appropriate rater ompany for water service to the subject
development o
14. PRIVATR SI'R=
All applicable subsections of Sections 13.5 and 13.6 of the R1:C
Ordinance (Ordinance No. 664) regards street improvement
requirements and covets shall apply to the subject developwnt.
15. FIRE ASS IANES
Emergency fire access lam shall be recorded as fire lane easements
on the final map and shah. meet Central Fire District s o
16. PEDESTRIAN EASE
Pedestrian easements over 1 the public sidewalk area shall be prepare
by the developer, approved by the: City Attorney and recorded against

17 o ABANDONED WATER W=
The prcperty owner shall seal abandoned or unused water wells if the
City, after consultation with the Santa Clara valley beater District,
determiners that said abandoned or unused water wells have a potential
to contaminate the water supply.
18. STREET IMPROVEMENM
On site and off site street iuprovements shall be implemented as
enumerated on the list below-.
1) Signalization at the intersection of Blue Jay Court and Homestead
Road to be fully paid by the developer.
2) Northbound right turn lane shall be installed at the intersection
of De Anza Boulevard and Homestead Road.
3) The developer shall dedicate right of way for three eastbound
travel lanes for Homestead Road and construct two eastbound. lanes.
Sidewalk shall be lore back fran curb a sufficient distance to
acpannodate the third eastbound lane on Homestead Road subject to
the review and approval of the Public Works Department.
4) The developer shall install Mans and landscaping on 'Homestead
Road, east of ' De Anza Boulevard and on De Anza Blvd. south of
Homestead Road to Highway 280, subject to the review and approval
of the Public Works Department.
5) The developer shall install a westbound right turn lane from
Homestead Road to northbound De Anza Boulevard if right of way
permits.
C) A landscaped median shall be installed on Blue Jay Drive. The
Median design shall be approved by the Director of Public Works.
The recommendation of approval is lased on wit by Mission
Engineers, Inc. laded Sheet 4.1 dated 9/9/88 of Application 10-TM 88
except as may be amended by the conditions contained heroin.
