Reso 4060CITY OF CUPERTINO Ank 10300 Torre Avenue Cupertino, California 95014 RESOLUTION No. 4060 OF THE PLANNING COFMISSION OF THE CITY OF CUPER2INO RECONMEDING DENIAL OF A CONCEPTUAL DEVELOPHM PLAN TO CONSTRUCT A TRIPLEX CONSISTING OF APPROMATELY 5,150 SQ. FT SECTION I.- FINDINGS WHEREAS, the Planning Commission of the City of Cupertino has received an application for a Conceptual Development Plan, as described below; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more Public Hearings on the subject application; and 'WHEREAS, the Planning Commission finds as follows with regards to the application: to The Conceptual Development Plan is inconsistent with the R3 (Multiple -family, Residential) zoning districts setback and height requirements. 20 The Conceptual Development Plan would adversely impact neighborhood property values. The structure's mass is architecturally inconsistent with other structures in the area and adjoining properties may experience adverse privacy impacts. NOW, TBE'REFORE, BE IT RESOLVE: That after careful consideration of maps, facts, exhibits,. testimony and other evidence submitted in this matter, the application for Conceptual Development Plan is hereby recommended for denial; and That the subconclusions upon which the findings and conditions specified in this Resolution are based upon are contained in the Public Hearing record concerning Application 1-CDPR3-88 as set forth in the Minutes of the Planning Commission meeting of May 24, 1988, and are incorporated by reference as though fully set forth herein.
