PSC 10-11-2019 CUPERTINO PUBLIC SAFETY COMMISSION SPECIAL MEETING MINUTES Friday October 11,2019, 5:30 p.m. Cupertino City Hall, Conference Room A CALL TO ORDER Commission Chair McCoy called to order this special meeting of the Cupertino Public Safety Commission at approximately 5:32 pm on Friday October 11, 2019 in the Cupertino City Hall, Conference Room A,located at 10300 Torre Avenue, Cupertino, California 95014. ROLL CALL Commissioner Present: Robert McCoy Neha Sahai Hymanand Nellore Yvonne Chao Andy Huang Commissioner Absent: None Staff Present: Captain Rich Urena, Santa Clara County Sheriff's Office Battalion Chief Wally Fink, Santa Clara County Fire District Others Present: Katy Nomura, Assistant to the City Manager Astrid Robles, City of Cupertino Leslie Zeller, Santa Clara County Public Health (via telephone) APPROVAL OF MINUTES 1. Subject: Approve September 12, 2019 Minutes Recommended Action: Approval of the September 12, 2019 Minutes i Commissioner Nellore motioned to approve minutes of the September 12, 2019 meeting; ; Commissioner Sahai seconded the motion; Ayes: Huang, McCoy, Chao, Sahai, Nellore. Noes: None. Abstain: None. Absent: None I POSTPONEMENTS None i Public Safety Commission Minutes October 11, 2019 ORAL COMMUNICATION None WRITTEN COMMUNICATION None OLD BUSINESS 2. Subject: Discuss policy options to prevent youth access to tobacco products, including flavored tobacco products, and to reduce the density of tobacco retailers. Recommended Action: Recommend that Council adopt the proposed tobacco policies to prevent youth access to tobacco products. Ms. Nomura gave a presentation on tobacco and a draft policy of preventing youth access to tobacco products. The businesses that are located around schools have all been contacted and are aware of the new policies which include a $425.00 yearly permit fee. Ms. Zeller shared that the government does not set an amount of how much tobacco inventory can be held on hand at any given time. The teen commission has requested a 1500 foot buffer for any new retailer to be opened around a school zone. At the current time the schools have been very supported of this proposal. Under this draft city policy, if a retailer is caught selling tobacco to an under aged person they will be fined for a 30 day period. If they are caught again they can lose their permit to sell tobacco. After a discussion amongst the commission, Commissioner Huang explained that the city could fund the program ($10,000) without requiring business owners to pay the $425 annual permit fee as businesses are already paying a fee to the state. He explained that the small business owners would be affected the most. Commissioner Sahai motioned to recommend that Council adopt the proposed tobacco policies to prevent youth access to tobacco products. Commissioner Chao seconded the motion;Ayes: McCoy, Chao, Sahai, Nellore. Noes: None. Abstain: Huang.
