APPROVED MINUTES, September 24, 2019
PLEDGE OF ALLEGIANCE
At 6:45 p.m Chairperson Wang called to order the regular Planning Commission meeting in the
Cupertino Community Hall Council Chambers, 10350 Torre Avenue, Cupertino, CA. and led
the Pledge of Allegiance.
ROLL CALL
Present: Chairperson R Wang, Vice Chair Vikram Saxena, Commissioners Kitty Moore, David
Fung, Alan Takahashi. Absent: none
APPROVAL OF MINUTES:
1. Subject: Draft Minutes of August 13, 2019.
Recommended Action: Approve or modify the Draft Minutes of August 13, 2019
Moved by Fung and seconded by Saxena to: "Approve the minutes". The motion carried 3-
0-2 (Moore recused, Wang abstain)
2. Subject: Draft Minutes of September 10, 2019.
Recommended Action: Approve or modify the Draft Minutes of September 10, 2019
Moved by Fung and seconded by Saxena to: "Approve the minutes". The motion carried 4-
0-1 (Takahashi abstain).
POSTPONEMENTS/REMOVAL FROM CALENDAR: None
ORAL COMMUNICATIONS:
Jennifer Griffin spoke about the censure of input by HOAs in Portland Oregon
Lisa Warren shared the comments she made at the August 20th City Council meeting with the
Commissioners
Peggy Griffin expressed her issues with finding and concerns about documents on the City's
website
WRITTEN COMMUNICATIONS:
Four emails were received regarding agenda item #3
CONSENT CALENDAR: None
PUBLIC HEARINGS:
3. Subject: Use Permit to allow the commercial parking and storage of vehicles in the parking
lot of an existing retail center (The Oaks). Application No(s): U-2019-05; Applicant(s): Patrick
Bumb (Stonebrook Asset Management);Location: 21269 Steven Creek Boulevard APN#326-27-
042, 043
Recommended Action: Conduct the public hearing and find that 1) that the denial of the
project is exempt from CEQA; and 2) deny the Use Permit per the Draft Resolution
Senior Planner, Gian Martire, reviewed the Staff Report and answered questions from the
Commissioners. The Property Owner, Mark Tersini and the Property Manager, Patrick Bumb,
addressed comments and questions from the Commissioners regarding parking and the
current uses at the shopping center.
Chair Wang opened the public comment period and the following individual(s) spoke:

Chair Wang closed the public comment period.
The Planning Commissioners discussed other parking options that might accommodate the
Farmer's Market, the other tenants, and the parking for Auto Nation. After discussion with
Staff, the applicant withdrew his application for a Conditional Use Permit. He will work with
Staff to obtain a Temporary Use Permit.
Moved by Wang and seconded by Moore to direct Staff to work with the applicant to obtain a
temporary use permit for the site which includes establishing a time limit, a maximum number
of cars allowed and for placement of the Farmer's Market that better serves the community.
The motion carried 5-0-0.
REPORT OF THE DIRECTOR OF COMMUNITY DEVELOPMENT: None
REPORT OF THE PLANNING COMMISSION:
Commissioners Moore and Fung mentioned the various public meetings and events they have
attended. Chair Wang has been researching the residential development projects along
Lawrence Expressway.
ADJOURNMENT:
The meeting was adjourned at 8:50pm to the next regular Planning Commission meeting on
October 8, 2019 at 6:45 p.m.
