PUBLIC HEARINGS I. Application 12-TM-75 of DEAETER ENTERPRISES: TENTATIVE MAP to divide 0.38+ acres into three.lots plus three lots to he held in common ownership. Said property is located westerly of and adjacent to Miller Avenue at the intersection of Miller Avenue and Calabazas Creek. First Hearing. The Planning Director explained this application had been postponed pending comments from the Water District. The Water District is interested in a minimum 20' setback from the creek. There has been a change in the site plan to three dwelling units on this planned development,. One of the issues is the entrance onto Puller Avenue without backing out onto this street. Comm. Adams asked if the staff was content with the new parking proposal. The Planning Director stated it is basically the same. Chairman Gatto asked for comments from the applicant and/or audience. Mr. Carl Young, 1400 Colena Avenue, said he was representing Demeter Enterprises in this proposal. He said they agree essentially with the staff's recommendation. They will use "grasscrete" in the front setback. He answered Comm. Cooper that these are three single-family homes with two -car garages. The garage doors are condusive to automatic door openers. Since there were no comments from the audience, it was moved by Comm. Adams, seconded by Comm. Woodward to close the public hearing. Motion carried:, 5-0 Moved by Comm. Adams, seconded by Comm. REACTIVATION OF USE PERMIT 20•.U-,73 of THE WESTFIELD COMPANY; USE PERMIT to allow construction of two 32,340 sq. ft. light industrial buildings, a total of 64,680 sq. ft. Said propertil is within -a P (Planned Development with .light industrial intent) zone and is located at the southeast corner of the � intersection of.Pruneridge and Tantau Avenues. First Hearing! i The Assistant Planning Director stated this use permit lapsed in j July 1974.. The proposal at this meeting is identical with the approved use permit. He said the applicant would like to have consideration given to the -possibility of enlargement of one of the buildings with a corresponding reduction in size of the other' The staff had no objection to this as long as there is.no change in the total square footage. The Assistant Planning Director stated the EIR was reviewed extensively.at the time of use permit' approval. Mr. Terry Rose, 21311 Milford Drive, Cupertino, representing The Westfield Company, said he has a prospective tenant who wishes to have 42,000 sq..ft. within :one structure, so he -is requesting permission to expand one building and decrease the other. He said he had no objection to the new Condition 19. Mr. Rose answered Comm. Cooper that he'does not anticipate truck traffic near the residences. The masonry wall is so designed as to deflect noise of the trucks from the residential area. Condition 23.relates to shift changes, if this should become, necessary. PC-210 Page 3 Mr,. Rose said all street parking is prohibited here. It is, therefore, important that adequate parking be provided on site. Otherwise, the cars will park around the corner in front of the residences, or the company will move out. Mr. Mike Stout, 520 Meadow Avenue, Santa Clara, 11epresenting the Westood Oaks Homeowners, said he sees no changes from the previou proposal. They would prefer no exit onto Pruneridge. In additio, where there are -now two driveways they were asking for one, large, 2-way curb cut.. He asked that the delivery restriction be expanded to include pickup trucks, and to include refuse collection. The Assistant City Attorney said copies of these conditions shoul be given to all lessees. Moved by Comm, 0°Keefe, seconded by Comm. Woodward to close the public hearing. Said property is within a P (Planned Development with Light Industrial Intent) Zone and is loca,�ed at the northwest corner of the intersection of !1runeridge and Tantau Avenues. First Hearing. The Assistant Planning Director re�jiewed the proposal. He noted the question of the setback will be r&3olved at H-Control time. Chairman Gatto asked for comments i:rom the audience. Mr. Mike Stout, 520 Meadow Avenue, Santa Clara, representing the homeowners in the area, said the people there have opted for sidewalks on both sides of the street. The south side is most convenient for the residents in the area. Moved by Comm. Woodward, seconded by Comm. O'Keefe to close the public hearing. Motion carried, 5-0 Moved by Comm. Adams, seconded by Comm. Cooper to approve application 10-U-75, subject to the conditions as listed in Resolution No. 1477. AYES: Comm. Application 14--TM-75 of BURDICK DEVELOPMENT COMPANY: TENTATIVE MAP to divide approximately one (1) acre into six (6) lots. Said property is located adjacent to and southerly of Rodriguez Avenue approximately 750 feet westerly of the intersection of Blaney Avenue and Rodrigues Avenue. First Hearing continued. The Assistant Planning Director noted the zone change was approved at the last meeting. The orientation of some of the buildings was a concern of the Conmissioners so the Tentative Map was continued, pending some rework. The staff has made recommendations, as noted in the December 5, 1975, staff- memo. MINUTES OF DECEMBER 8, 1975 PLANNING COMMISSION MEETING The Assistant Planning Director answered Comm. Cooper that he doubts that the Water District has plans for cementing or rock - lining the creek. Civil Engineer Warren Whaley., 22275 De Anza Circle, said he knows of no restrictions against a fence along the creek. Developer Norman Burdick said Unit B on Lot 2 and Unit B on Lot 4 have been shifted slightly. He referred to the updated site plan on the bulletin board Moved by Comm.. O'Keefe said his dissenting vote is consistent with his dissenting vote on the zoning.. Minute Order passed, 5--0 5, Application 12-U-75 of PHOTOTECHNOLOGY: USE PERMIT to allow a photo kiosk in a CG (General Commercial) Zone. Said.pro- perty is located at the southwest corner of the intersection. of Stevens Creek Blvd. -and East Estates Drive. First Hearing. The Planning.Director reviewed the staff report dated December 5, 1975-, on this application, including the trip end performance standard.. This is not a full-fledged. commercial building. Mr. Phillip Sefrs, Berkeley, said it is their experience that they do not generate new traffic but rather depend upon the traffic already there. These kiosks are guaranteed to last more than 20 years. They have never had more than 2 cars waiting in line at their kiosks. He said they want to be a viable part of this community. Comm. Adams asked how many customers might this business anticipate in one day. Mr. Sefrs said that from 9 a.m. to 8 p.m., Photomat generates 40 rolls of film per day average, with 2 rolls per customer; this means 20 cars. The average time at the window for each car is 2-1/4 minutes. Chairman Gatto asked if this was strictly walkup rather than driveup, how this would change the unit in order to function economically. Mr. Sefrs said they rely on the convenience to the customer, and as long as the automobile is already there, the customer will just swing by the kiosk before or after the other shopping. Comm. O'Keefe explained to the applicant the concern of the City in regard to air quality and what happens with car engines idling. Mr. Warren Yee, No. 1 Fifth Avenue, Oakland, stated he has been doing the site plan for the applicant. ETe did some parking studies. Ile said there are 134 parking spaces, and during peak hours the parking stalls out near the proposed location of the kiosk were unoccupied. Moved by Comm. O'Keefe, seconded by Comm. Woodward to close the public hearing. Motioi carried, 5-0 Comm. Cooper said she would like a staff report on driveup facilities. She believes this application should be continued until a decision has been made as to the City's policy regarding driveup facilities. Comm. Woodward said this is a small shopping center and the parking lot is never full. He does not at this time have enough data to determine whether an idling car pr,�du.ces more or less emissions than a moving car. Comm. Adams felt the issue was whei._her or not the City wants to have these types of anscillary commercial installations in our commercial developments. There are none in the City at the present time. He believes they degrade the quality of the commercial development. He believes the traffic and air pollution problems are secondary in this case, since most of the traffic is already there. o MINUTES OF DECEMBER 8, 1975 PLANNING COMMISSION MEETING PC-210 Page 7 Comm.. O'Keefe said he would not want to restrict any business opportunity with a blanket policy statement against it. Before this was continued he said he would like an informal vote on it. Comm. Woodward said he would like to judge each application on its own merits Comm, Cooper said she is not in favor of a small, freestanding, structure in a commercial parking lot. She would not like to foster this type use in the City of Cupertino. ChairmanlGatto said he would not be in favor of any blanket statements. He was not in favor of restricting this. Mr. Sefrs*said he did not understand the Planning Commission's concerns. He asked them to consider whether or not the public would like this business, not whether the Commissioners'personall like it. Comm. O'Keefe said his major concern is traffic circulation. Upon request of the applicant, it was moved by.Comm. Woodward,, seconded by Comm. O'Keefe to reopen the public hearing. Application 14-U-75 of WATKINS-JOHNSON COMPANY. USE PERMIT to allow construction of 2-story building containing 160,625 sq. ft, in a P (Planned Development with light industrial use intent) zone. Said property is located adja- cent to and southerly of Pruneridge Avenue approximately 500 feet westerly of Tantau Avenue. First Hearing. The Planning Director said this property is a part of Phase III in regard to traffic constraints. The 47' high building is somewhat higher than the others in this industrial park. However, this location is in the heart of.the industrial park and well away -from residences, Comm. Adams granted the matter of sidewalks addressed. PC-210 Page 8 MINUTES OF DECEMBER 85 1975 PLANNING COMMISSION MEETING Comm. Cooper wanted an elaboration of the rationale for the height of the building. Architect Joe Ehrlich of Ehrlich, (left and Rominger, said their building has a 3 foot pedestal of Earth on which it is standing. The top floor is 10 feet high and houses all the mechanical and electrical equipment that usually is located in penthouses atop the roof. This allows the user to make changes if major mechanical or electrical equipment problems occur. Mr. Ehrlich said 80% of the Watkins -Johnson traffic arrives at 7 a.m. and leaves at 3.30 p.m. In 1968 Watkins --Johnson put in the road. Then Westfield was allowed to put in an adjoining driveway and now Watkins -Johnson is being asked to modify their driveway because it is too close to the Westfield driveway. Also, if the sidewalk is deleted it will mean additional landscaping and maintenance. There are no trees on the site. A commercial florist is growing asters on the sites of future units B and C. Vallco Park General Managcr Walter Ward said it is their intent to use this property as agriculture. (sites for units B and C). He said you cannot see it over the berming. In regard to the sidewalk, there is a large sidewalk by the hctel. It has been the intent of Vallco that people use the sidewalks to go from one area to another. In regard to the height of the structure, this 47' high structure is 2' lower than was approved by their Architectural Review Board in 1968. Full enclosure of the mechanical ecui_pment this way is far superior to installation on the roof. He an,;w,ared Conmi. O'Keefe that this internal sidewalk did not pose a s(curity problem. Moved by Comm. O'Keefe, seconded by Comm. Adams to close the public hearing. Motion carried, 5-0 Comm. Adams said he would like to add a work shift condition to this approval. There was a lengthy discussion of the close proximity of the two driveways. Comm. Adams suggested the Watkins -Johnson driveway weave in through the property to the other side of Unit C. Chairman Gatto felt the time to address this was when the Westfield application was approved, ■ MINUTES OF DECEMBER 8, 1975 PLANNING COMMISSION MEETING Mr. Ehrlich pointed out the Watkins -Johnson site is 30 acres with 2 accesses. Westfield has 5 acres and 3 access points. If any change is made, he believes Westfield could function with 2 accesses. He answered Chairman Gatto that he would much rather enter into some type of joint entrance than to weave the road around Unit C. Chairman Gatto preferred to delete Condition 18 in the staff memo The landscaping has been installed by this applicant and he felt it would be unfair to now require him to put in a sidewalk. Application 13--Z-75 of CITY OF CUPERTINO: REZONING AND PREZONING 17.9 acres from various City and County zoning districts to zoning districts which are consistent with the , adopted General Plan, The 17.,9 acres are generally located in an area bounded by .Alcalde Road, Foothill Blvd., and Santa Lucia Avenue, First Hearing. The Assistant Planning Director reviewed the viewgraph of the valley floor adopted by the City Council last Fall. This is a requirement, by State Law, that the City must zone properties in accordance with the General Plan. He next reviewed the composite zoning map and recommended zoning districts. There are 9 duplex structures in the area presently under discussion. The City is saying that in .the long term (20-30 years) , the duplexes in this area should be phased out,e Chairman Gatto asked for comments from the audience. Mr. Dave Voss said his ro ert on the corner of Alcalde is P P y surrounded by duplexes and yet the City is recommending his lot be zoned for a single-family residence, He said this lot is too large for one single --family home and too small -for two singlenf amily homes. It is just right for a duplex.. Mrs.. Kolski, 10530 Santa Lucia, said Inspiration Heights was laid out with front and rear flag lots. The County zoned it. She is. surrounded by duplexes and.would like to have her property remain zoned for duplexes. Mike Troiano, 10751 Stevens Canyon Road said he is at the corner of Santa Lucia. Ile is concerned about what he will inherit if he comes into the City in regard to taxes, etc. He was told the City tax is 26�/$100 assessed valuation. Comm. O'Keefe said lie would like to continue this application to give him time to walk the area. Chairman Gatto said he,has driven around there. For the most part, this is a pretty well established neighborhood. lie is not sure the history and character of this neighborhood should be destroyed. The staff was asked to check on the overall density of the area to see if this conflicts with the General Plan. Chairman Gatto said the intent of the General Plan is to create general density. He is not disturbed by the mix of uses in this area. Comm. Cooper would like to know the .location of the substandard lots. Moved by Coppm. O'Keefe, seconded by Comm. Adams to continue this public hearing to January 12, 1915. Motion carried, 4-0 UNFINISHED BUSINESS: None. NEW BUSINESS: None. REPORT OF PLr1NNING CWIMISSION Comm. Cooper is concerned about approving large industrial structures in terms of what this does to the housing situation in'this area. She would like to know how many employees are anticipated and their income level. Chairman Gatto has had calls about the outside lights behind the new shopping center near Coco's shining, into residences' back yards.
