PUBLIC HEARINGS
1. Application 13-U-75 of USHIRO HOSONO: USE PERMIT to allow
construction of a restaurant in a CG (General Commercial) Zone.
Said property is located at the northeast corner of the inter-
section of Bandley Drive and Alves Drive. First Hearing.
The Planning Director summarized the December 19, 1975, staff report
on this application to allow construction of a 3,470 sq. ft. Japanese
restaurant. A portion of this property will remain undeveloped at
this time, and will be turfed. This applicant is using 5 of the 16
trip ends allowed for this acre of land. The staff recommended
approval of this application, subject to 19 conditions recorded in
the staff report.
Realtor Don 0, Bandley, 10054 South Highway 9, Cupertino, stated he
was representing Mr. and Mrs. Hosono and the Saich Family. He said
this restaurant will serve authentic Japanese lunch and dinner. They
are in full agreement with the Planning Department's recommendations.
The undeveloped land will remain so until such time as there is the
need for a modest expansion of the facility and perhaps a small gift
shop.
Comm. O'Keefe was very much in favor of this proposal; it will brighten
up this particular area. It is his contention that you don't have to
have frontage along either Stevens Creek Blvd -nor Saratoga -Sunnyvale
Road in order to have a successful business.
Since there were no further comments from the audience, it was moved
by Comm. Adams, seconded by Comm. O`Keefe to close the Public Hearing.
Motion carried, 4-0
Moved by Comm. O'Keefe, seconded by Comm. Adams to approve application
13-U--75 in accordance with the staff's recommendation.

2. Application 3-V--75 of JOSEPH F AND AN RZOD0 o VARIANCE
request from Ordinance 220(n), Section 10.3,to reduce: the
required side yard setback of a -two-story structure from
nine `(9) feet to six (6) feet. Said property is located ;
at 10463 Noel Avenue, First Hearing.
The property was located on the aerial ;photograph by the'Assistan�
Planning Director. The neighborhood consists of single -story and-1
two-story. structures The applicant's request teas to deviate frog

ture with a 6` setback.
The Assistant Planning_ Director said State and Local Law dictate
the three criteria available for granting of a variance.. The
applicant must demonstrate there is some uniaue.circumstance,,
an economic hardship:, and he would have to prove `the .variance
would not be injurious.to the neighborhood. }
Mr. Joe Rando, 10463 Noel Drive, Cupertino, said he has considered:
both alternatives and felt the plan bringing the second story
out to the :6` setback line was the most attractive. He has seen
an example of the other alternative and feels it is unattractive;!
He said they are trying to get. maximum use of their property.
He said there was nothing that makes his proposal precisely
unique. He referred to Exhibit 3 of 3-V-75.
Mr. Rondo answered Comm, Adams that his is a pie -shah_ ed lot and
there is room for another room .in the back, but this would wipe
out any plans for their backyard.

3. Application 2-GPA-75 of CITY OF CUPERTINO: GENERAL PLAN
AMENDMENT proposing a change in the traffic constraints
within Vallco Park relative to construction phasing. The
property is generally located adjacent to and westerly of
Wolfe Road immediately southerly of the Vallco Village
Shopping Center and contains 3.1 acres. First Hearing.
The Planning Director recapped the previous action on this proposal.
The traffic projections for Sears and this center are not going to
be as great as initially proposed. A 50% reduction has been decided
upon for Friday peak hours for banks.
Comm. Adams was concerned about what effect this will have, down-
stream. Comm. O'Keefe felt this would be setting a precedent.
Chairman Gatto noted there would be improvement of the Pruneridge
and Wolfe Road intersection.
Mr. Walter Ward, Vallco Park General Manager, said the things brought
up at the City Council meeting were the rendering of the twin office
towers which has received prior approval as opposed to the present
proposal for a 40,000 sq. ft. bank facility with drive -up and walk-up
windows to accommodate people already in the area.
The Planning Director reviewed the traffic reduction plan in the EIR.
The signalization of Pruneridge and Wolfe Road is tied to the
development of this property. There will then be a better and safer
traffic movement through Vallco Village.
Mr. Ward answered Comm. Cooper that there will still be about
49 Vallco Park uncommitted acres.
Since there were no further comments from the audience, it was moved
by Comm. O'Keefe, seconded by Comm. Adams to close the Public Hearing.

Comm. O'Keefe said he wishes to allow Vallco Park to develop
their property -as they see fit, but he, too, is looking for zero
increase in traffic. -.
Comm. Cooper said her position on'.this.matter has not changed.
She said she cannot at this time feel comfortable with this
proposal.
Comm`. Adams said he goes along with the development of this
property but he, too, would like :to see zero traffic increase. --

approximately 75 acres from various zones to -Planned
Development Residential/Commercial/Industrial. The
75 acres are generally .lo.cated. westerly of Saratoga --
Sunnyvale Road between Route 280 Freeway and Alves
Drive. First Hearings
The Assistant Planning Director reviewed the previous hearings
on the Highway 9 Conceptual Plane He said the Mariani design
group .is preparing a plan for the east side of Saratoga.-
Sunnyvale"Road-. The plan is essentially the same as reviewed
by .the Planning Commission previously. The staff is interested
in building masses adjacent to roadways He referred to the ,
.December 18, 1975, staff memo describing the development plans
for the Garner property, the Sobrato-Berg. property, and what is
known as the Dr, Brown property.

The Assistant Planning Director stated that if there is a conflict
of conditions, the conditions of previously approved applications
will win over conditions of approval of this application for rezoning.
The City Council is interested in seeing bicycle storage facilities
in industrial zones, so Condition 6 has been added. Appendix B sets
forth the precise landscaping detail for Saratoga -Sunnyvale Road.
H-Control feels the screening should be very intense. Appendix B
has been modified to screen cars but not to completely hide the
structures. The Planning Commission determined the owners would be
able to transfer trip ends from one property to another within a
Planned Development.
Chairman Gatto asked for comments from the audience.
Dr, Brown said this entire proposal is ridiculous.
Moved by Comm. Adams, seconded by Comm. O'Keefe to close the Public
Hearing.

Moved by Comm. Adams, seconded by Comm. Cooper to approve application
3-Z-75, subject to Conditions 1-14 as enumerated in the staff report,
including the Resolution dated December 18, 1975.

5. Review of Planning Policy Co= ittee information pertaining to
Community Care Facilities.
The Planning Director stated that recent State Law indicates that
care of six or less persons in group care facilities can be in
residential zones. Further, the City has the right to require a
use permit as long as conditions are not applied. Safety is an issue
to be considered.
