PC Reso 147710-U-74 (Reactivation) RESOLUTION NO. 1477 OF THE PLANNING COMMISSION.OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW CONSTRUCTION OF ONE ONE-STORY BUILDING CONTAINING 19,400 SQ. FT. APPLICANT°. The Westfield Company (Westfield IV). ADDRESS: 990 East Arques Ave., Sunnyvale, California 94086 SUBMITTED: November 13, 1975 LOCUTION. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does f G exist, the special conditions as enumerated herein shall apply. 15. Approval is based upon Exhibit A of 10--U-74 as may be modified by I additional conditions contained herein. I i 16. That the westerlymost curb cut on Pruneridge Avenue shall be f terminated should the City. Council determine that driveway consolida- ` Lion is desirable. The City Council shall make said determination in conjunction with a subsequent review of a use permit application involy! ing the southeasterly portion of the Hewlett-Packard Development Plan. 17. That the easterlymost curb cut on Pruneridge Avenue'be closed. `Said deletion -.will cause approximately 3-4 parking -spaces to be eliminated to provide circulation space. 18.' As a condition to this approval, applicant or its successors shall participate in street improvements required by the Construction Phasing for Vallco Park memo, as revised, which is a part of the Core Area General Plan Amendment adopted by City Council Resolution No. 3592. The participatiLi shall be in the form of a local improvement district, or by direct participation if all affected property owners agree. The applicant's share shall be .determined in the manner prescribed by law f, for a local improvement district and applicant's consent to such dis- trict shall be irrevocable. The applicant shall enter into such a district upon ninety (90) days advance notice by the City. 19. No outside e e 9 i e chemical or as storage tanks or other outside story g g o s g facilities shall be constructed without review and approval of the Planning Commission. The purpose of said review shall be to ascertain the.visibility., atmosphere and safety impacts on the adjacent area and the reduction of parking spaces within the site. 20. A five --foot sidewalk shall be installed on Pruneridge Avenue. The configuration of the sidewalks shall be determined by the Architectural and Site Approval Committee. The City will enter into an agreement to reimburse the applicant for portions of the sidewalk where the expenses therefor can be.assessed to other properties. I! i' . L, C I T Y O F C U P E R T I N 0 N City IIall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING APPROVAL OF A USE PERMIT WHEREAS, the Planning Commission of the City of Cupertino received an application for a USE PERMIT, as stated on Page 2; and WHEREAS, the applicant has met the burden. of proof required to support said application; and WHEREAS, the Planning Commission finds that the application meets the following requirements: a. Encourages the most appropriate use of land, b. Conserves and stabilizes the value of property, c. Provides for adequate open spaces for light and air, d. Permits adequate control of fires, e. Promotes the health, safety and public welfare, f. Provides for the orderly development of the City, and g. Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located; NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits and other evidence submitted in this matter, the application of the USE PERMIT is hereby recommended for approval, subject to the conditions stated on Page 2; and BE IT FURTHER RESOLVED: That the aforementioned findings be approved and adopted, and that the Secretary be, and is hereby directed to notify the parties affected by this decision. That the property owner/developer shall provide tenants with a written notice regarding potential traffic problems within the Vallco Park area. Said notice shall stipulate that the City reserves the right to review traffic conditions within the area at any time in the future and should the City determine that constraints to'insure proper traffic movement is necessary, the City may impose the appropriate constraints. This may take the form of staggering of work hours by tenants, modification of hours of operation, or a tenant -organized car poo.ling.program and County transit bus pooling program. A copy of said written notice shall be signed by the lessee and forwarded to the City prior to occupancy of.the building. 22. That the applicant/owner or his successor shall ensure that all future lessees of building receive a copy of the conditions of approval for this use permit.. PASSED AND ADOPTED this 8th day of December, 1975, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote.
