OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW
CONSTRUCTION_ OF TWO 32,340 SQ. FT. LIGHT INDUSTRIAL
BUILDINGS, A TOTAL OF 64,680 SQ. FT.

Cf'NDITIONS AND FURTHER FINDINGS:
1-14o Standard.Conditions to the extent that they do not conflict with the
special conditions enumerated herein. - In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. That the application is approved based upon Exhibits A, B-1 and B-2
of 20-U-73 as may be modified by additional conditions contained
herein:
16. That a 10-fte minimum landscaped area be installed adjacent to the
easterly property line be approved by Architectural and Site Approval
Committee and further that an 8-fto high masonry wall be installed
adjacent to the property line to tenuate sound that m*ay be trans-
mitted from industrial processes conducted on the site and.the on -site
traffic generated by the facility. Additionally, three (3) parking
spaces on the northeast corner of the parking lot shall be eliminated
and replaced with landscaping:
17. That the two curb cuts on Pruneridge Avenue be consolidated into a
single ingress and egress point..
18. That the provisions of Section 115 of Ordinance"220(k) related to
performance standards for emissions shall apply:
19. As a condition to this approval, applicant or its successors shall
participate in street improvements required by the Construction Phas-
ing for Vallco Park memo, as revised, which is a part of the Core. Area
General Plan Amendment adopted by City -Council Resolution No. 3592e
The participation shall be in the form of a local improvement.distrct,
or by direct participation if all affected property owners ;agree.The
applicant's share shall be determined in .the manner prescribed by law,
.for a local improvement district and applicant's consent to such"dis-
trict shall be irrevocable. The applicant shall enter into such a
district upon: ninety (90) days advance notice by the City.
20. That the number of off-street parking spaces may be reduced to.260
spaces by the Architectural and Site Approval Committee to provide
appropriate screening of parking lot entrances from Pruneridge.Avenue
and Tantau Avenue:

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and •
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.

21. No outside chemical or gas storage tanks or other outside storage
facilities shall be constructed without review and approval of the
Planning Commission. The purpose of said review shall be to ascertain
the visibility, atmosphere and safety impacts on the adjacent area and
the reduction of parking spaces within the site. ;
22o Truck movements including garbage pickup, on, the site shall be restricted
to the hours of 7030 a.m. and 6<00 p.mo- during weekdays and Saturdays.
Truck movement shall be prohibited entirely on Sundays.
23. That; the property owner/developer-shall provide tenants with a written
notice regarding potential traffic problems within the Vallco Park area.
Said notice shall stipulate that the City reserves; the right to review
traffic conditions within the area at any time in the future and should
the City.determine that constraints to insure proper traffic movement
is necessary, the City may impose the appropriate constraints This may
take the form of staggering of work hours by tenants, modification of hours
of operation, or a tenant -organized car pooling program and County
transit bus pooling.program° A copy of said written notice shall be
signed by .the lessee and forwarded to the City prior to occupancy of the
building.
24. That the applicant/owner or his successor shall ensure that all future
`lessees of building receive a copy of the conditions of approval for .
this use permit
25 The applicant shall have the ability to modify the building footprint
for either building so long as the total square footage is not increased
and the site design concept is not.altered< The Architectural and Site
_Approval Committee shall review subsequent site plan changes.
