Minutes of the July 11, 2019 Housing Commission meeting were approved as written. Commissioner Cunningham made a motion and Commissioner Daruwalla seconded the motion. Below Market Rate (BMR) Linkage Fees Update for the Cupertino BMR Housing Program The Commission accepted a presentation from staff member Kerri Heusler, Eric Phillips of Goldfarb & Lipman, and Sujata Srivastava of Strategic Economics. Staff and the consultant team answered questions from the Commissioners and members of the public. Public comments were received from Leanna Crabtree and Jennifer Griffin. The Commission proposed the following changes: Residential Prohibit in-lieu fees entirely for residential 7+ units Recommend the following inclusionary policies: o Single Family- 20% o Townhomes/Condos- between 20-25% defending on feasibility 2 o Rental- no change Explore specific inclusionary percentages in between 15%, 20%, 25% for prototypes 1, 2 & 3 Include additional language in alternative means of compliance: o Developer has to require an equivalent number of offsite units o Acquisition of existing unit with a requirement to rehabilitate as BMR units o Land donation option Decide implementation date of new policy with consideration for the BMR units at the Oaks Review existing parking policies with the goal of removing barriers to affordable housing with a focus on reducing development costs and creating incentives around parking Explore a prototype of apartments without retail to see if it is feasible Non-Residential Recommend the following fees: o Office / R&D- between $25-30 o Hotel- $15 o Retail- no change Commissioner Cunningham made a motion and Commissioner Daruwalla seconded the motion. Review list of City owned parcels to be considered for affordable housing (APN, lot size, land use) and provide any input to staff Background The Fiscal Year (FY) 2019-20 City Work Program was adopted by City Council on April 2, 2019. The Housing Commission Work Program includes the following item: Identifying a list of City owned parcels to be considered for affordable housing (APN, lot size, land use). Discussion A list of City owned parcels was created and reviewed for potential affordable housing locations. It was determined that the following City owned properties could be considered for affordable housing: APN Description Zone Land Use Address Current Use & Potential Approx. Gross Lot Area 357 11 020 10301 Byrne Ave Acquisition R1-8 Resid ential (0-4.4 DU/A c.) 10301 Byrne Avenue FY 2019-20 City Work Program item: feasibility study underway for Blackberry Farm entrance, which could impact the property with dedications/easement and help determine residential uses. Single family home on site. Approx. 0.393 Acres (17,112 SF) Max. Base Density = 1.73 Units (1 Unit) 357 07 029 Stevens Creek Corridor between Blackberry Farm and McClellan R1-7.5 Low Densi ty(1-5 DU/A c.) 22240 Scenic Circle Vacant. Considerations: 1) Unsure of Net Lot Area; Storm Drain Easements located on property 2) FEMA Flood Zone 3) Liquefaction- Inundation Geologic Hazard Zone 4) Part of Park System, though not zoned as Park 3.45 Acres (150, 415 SF) The 10301 Byrne Avenue Acquisition site is included in the FY 2019-20 City Work Program / Housing Commission Work Program under the following item: Engage with philanthropic organizations to find a way to build extremely-low income (ELI) housing units for developmentally disabled (DD) and engage with Habitat for Humanity (or other non-profit) to build ownership housing at 10301 Byrne Avenue (Priority Setting Item). A feasibility study is underway to determine potential residential uses. This item will be brought forward to the Housing Commission in Spring 2020. The Stevens Creek Corridor between Blackberry Farm and McClellan site has certain physical constrains that would need to be evaluated in order to determine feasibility and cost of construction. Next Steps Evaluate and consider list as part of a future Housing Commission program.
