15. That the approval is based upon the conceptual site plan labeled
Exhibit B, 1st Revision, as may be amended by additional conditions
contained herein.
16e Thattheintensity of development of the development area as defined
by Exhibit B,`1st Revision,,shall be limited to land uses that will
not generate more than 16 one-way vehicular trips per acre during the
peak poma traffic hour. Detailed traffic generation analysis -shall
be conducted,durin the definitive plan (use permit phase of the planned
development review process).
17. That the property owner/developer shall provide tenants with.a written
-notice regarding potential traffic problems within the zoning boundary.
Said notice shall'stipulate that-the'City reserves the right to review
compliance with the 16.trip end constraint at any time in the future
and.that.should the City determine that the constraint is exceeded, the
City may ..impose additional measures to ensure compliance.- This may take
the form of staggering of work hours by tenants, modification -of hours
of operation, . o.r a tenant -organized car pooling program 'and. County
transit bus pooling program. A copy of said 'written notice shall be
signed by the lessee and forwarded to the City prior to occupancy of
the building. (As amended by the City Council at the meeting of
November 17, 19-75)
18, That the applicant/owner agrees to participate'in a reciprocal drive-
way.and parking lot easement agreement with the neighboring property
owners to the east so.as to allow for the interconnection of both
properties. The precise location of the east/west main "circulation
route" interconnection between the neighboring property (Mercury
Savings) and the subject property shall be determined during a sub-
sequent review of a definitive plan involving the easterly segment
of'the-subject property.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has been submitted to the City of
Cupertino requesting a change of zone in the zoning regulations of the
City, as stated on Page 2; and
WHEREAS the Planning Commission has held at least one public hearing
in regard to the application on the date as noted on said application;
and
WHEREAS the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as required by
the Zoning Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a) Encourages the most appropriate use of land,
b) Conserves and stabilizes the value of property,
c) Provides for adequate open spaces for light and air,
d) Permits adequate control of fires,
e) Promotes the health, safety and public welfare,
f) Provides for the orderly development of the City,
g) Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located.
That said Planning Commission, therefore, reports favorably to the City
Council in the matter of granting said zone change.

19. The easterlymost curb cut on Stevens Creek Boulevard is not approvedM
in conjunction with the subject,conceptual plan. The final disposition
of the easterlymost curb cut shall be determined in conjunction withsubsequent definitive plan (use permit) rev iewo A commercial driveway

20. The initial development within the planned development shall be
responsible for installation of full landscaping improvements for
street frontages directly involved in the approved definitive plan

All developments other than Rl, R2 and R3 zoning shall
be served by on -site storm drainage facilities connected
to the City storm drainage system. If City storm drains
are not available, drainage facilities shall be installed
to the satisfaction of the City Engineer.

The applicant shall be responsible for complying with the

requirements of the Underground Utility Ordinance No. 331
and other related ordinances and regulations of the City

of Cupertino, and shall make the necessary arrangements
with the utility companies involved for the installation

of said facilities. The applicant .shall ,submit a detailed
plan>showing utility undergrounding provisions° (This
plan must have prior approval of.the utility companies
and the City Engineer).

10. The location of all buildings, fences, roadways, park-
ing areas, landscaping and other facilities or features
shall be as shown on the site plan submitted labeled
"Exhibit A", except or unless indicated otherwise
herein.
11. Parking must meet the requirements set forth in
Cupertino City Ordinance No. 002(q) and must be in
accordance with the approved plot plan.
12. A masonry wall will be built by any commercial developer
to separate such commercial area from any residential
area; such wall shall be six feet high above the highest
adjoining finished grade.
13. Landscaping areas shall be maintained as shown on site
plan. Detailed landscaping plans, related to arrange-
ment, selection of plant materials and sizes, shall be
approved by the Architectural and Site Approval Com-
mittee and City Council prior to issuance of a building
permit.
14. The applicant shall be responsible for completing the
site as shown on approved plot plan and shall be required
to enter into a development agreement with the City of
Cupertino providing for payment of necessary fees, includ-
ing but not limited to, checking and inspection fees,
storm drain fee, and underground utility fee. Said agree-
ment shall be executed prior to the issuance of a building
permit.
