AMENDING THE SITE PLAN AND OPERATIONAL CONSTRAINTS
FOR THE CUPERTINO HILLS SWIM AND RACQUET CLUB

FINDINGS:
The revised site plan is labeled Exhibit A lst Revision, dated February.28, 1975.
The building elevations for the proposed clubhouse, covered barbecue area and
children's play area is not approved. The grading plan for said areas of the
site .is to be reviewed by the Architectural and Site Approval Committee prior
to issuance of building permit(s).
The operation of the racquet club is governed by the following conditions:

1-12. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein.. In the event a conflict does

13 On -site parking shall be provided as follows:

a. One -(I) space for every four (4) families. Parking
spaces must be provided prior to any increase in
membership.
b. The parking facilities shall be laid out according
to City of Cupertino standards.
14. Fences shall be six (6) feet in height and shall beerectedso as to
secure the entire area. The fences on the north, east and west
boundaries shall be of a solid wood nature; and the fence along the
golf course may be a chain link variety if the view is to be preserved.
An entrance/exit gate shall be provided and it shall be kept locked
when the club is not in operation.
15. Landscaping, reviewed at a public hearing before the Architectural
and Site Approval Committee and satisfactory to them, will be provided
-adjacent to all residential zones to serve as a sound and light barrier.
It is recommended that trees of a substantial height be planted on the
east and south property lines. It is noted that the tennis courts will
require ten. (10) foot fences, therefore •a screen of trees should be
placed between the courts and the security fence

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires, _
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.

The applicant shall be permitted to retain parking lighting at six (6)
feet in height and other on -site lighting not to exceed four (4) feet
in height. 'No lighting of any type or style shall be fixed to the.
tennis court sites (existing or proposed) that would allow or encourage
activity on the courts beyond nightfall. The applicant shall submit
plans to the Architectural and Site Approval Committee should the
applicant desire to modify the height limitation for the parking.and
non -tennis court orientated on -site lighting. If a lighting application
is filed, the ,Architectural and Site Approval Committee shall ensure
that there is no Light spillover into adjoining residential`` yards.

The hours of operation for outdoor activities shall be limited to

7:00 a.m. to 10:00 p.m. on all days. The outdoor evening time
limitation shall be reviewed by the Planning Commission in the event

the City receives complaints from neighboring property owners,

Nophonographs, radios ublic address or paging systems, powered

megaphones, bells, buzzers, or similar noise making devices will be
permitted outdoors at any time. No starting pistol or hand mega-
phones permitted to be used prior to 7:30 a.m. on weekdays and
8:30 a.m. ,on weekends or holidays. The same hours of operation shall
apply to motorized equipment such as lawn: -mowers, rototillers,.saws,
etc.

The improvement of Rae Lane to City standards is required.
20.
Indoor evening activities are permitted if they do not create noise
obnoxious to surrounding residences. The hours of operation for
indoor activities are,limited to 7:00.a.m. to 10:00 p.m. Sunday
through.Thursdd.y;and all holidays, and 7:00 a.m. to 11:-00 p.m. on
Friday, Saturday and any day preceding a holiday. The Planning.
Commission.shall have the ability to review the evening activities
of the club in the event complaints are received from adjoining
homeowners.
21.
Any.building,- including its lighting, is subject to public hearings
before the Architectural and Site Approval Committee.
22.
That prior to an inter -club or other non-member orientated tournament,
an off-street parking plan shall be reviewed by the City -staff`. The`.
purpose of the plan review is to ensure that the immediate residential
-
neighborhood is not impacted by patrons of the, tennis tournament.

There shall be no sale of alcoholic beverages on the .premises.
