CALL TO ORDER
Commissioner Huang called to order this regular meeting of the Cupertino Public Safety
Commission at approximately 6:00 p.m. on Thursday, February 8, 2018 in the Cupertino City
Hall, Conference Room A, located at 10300 Torre Avenue, Cupertino, California 95014.

ORAL COMMUNICATION
Ms. Chole presented a Power Point presentation of the proposed bike trail on the Regnart
Creek Trail. She explained to the Commission that this bike trail would certainly provide
children a safer route to and from schools; however she worries about the safety of children
who may use the trail as it is secluded. She further asked for guidance from the
Commissioners to have their message heard by a broader audience.
Ms. Wyckoff expressed her concerns on the Regnart Creek Trail. She and her neighbors are
against this trail moving forward. Opening this alley way would create a new area for
unwelcomed activities. There appears to be no access for any emergency vehicles if an
emergency were to arise. Lighting is a concern as the area is currently dark and if lights are
installed, the lights will illuminate homes nearby.
Ms. Daston explained that the route is not safe for children. Traffic and streets are not a
straight route and due to many crossings along the trail, and going between traffic as they
were to cross Blaney Street, the trail is unsafe. Mrs. Daston explained her three main concerns:
1) City council denied this proposal in 2005 and no changes were made to the trail.
2) The trail does not make it a short cut to the schools due to the street crossing.
3) It will be huge cost to the city to get this trail up and running.
Ms. Miyakawa explained that she walks this area on a regular basis and does not think this
would be a wise proposal. She has almost been hit by a car once, even though there is a 3-
way stop there. Some of the homes face the trail directly, which would affect their privacy,
should the trail be built.
Deputy City Manager Jacqueline Guzman explained to the public speakers that the best
audience to express their concerns to would be the Bike Pedestrian Commission since they
are already working on this proposal.
WRITTEN COMMUNICATION
Commissioner Huang advised of a Disaster Council Meeting on Thursday February 15, 2018
at 2pm as well as an email he received in regards to Sheriff Smith’s upcoming 6th term election
as he wants to make sure all commissioners are aware.

Commissioner McCoy explained he is planning on hosting his community safety forum on a
Friday evening in October, he will be arranging with the City to book a community room and
set a date for the event.
Commissioner Nellore will be obtaining some more information on the Transportation Safety
updates and will bring back safety concerns at the next Commission meeting. Commissioner
Nellore plans on having 3 more neighborhood block meetings this year, one in each quarter;
he will be contacting Mrs. Turini to arrange areas and date for the neighborhood watch
events. Commissioner Nellore inquired about how to enable a seminar in order to have a
weekly training for neighborhood watch groups. Ms. Guzman responded by adding that the
person to contact for any Neighborhood Watch training would be Mrs. Turini. Block Leaders
meet on a quarterly basis and more information is posted on their website.
Commissioner Sahai explained she would like to add child safety to the forum.

5. Subject: Cupertino Social Host Responsibility Ordinance
Recommended Action: Recommend the City Council adopt draft Social Host Ordinance
Teen Commissioner Benita Vemula explained her support for ordinance No. 17. She added
that both parties should be held responsible (child and parent). Teen Commissioner Vemula
thinks the kids should have to do community service and the parents should pay fines, in
hopes that this will make them think about the consequences of their actions. The Teen
Commission would like to sponsor a seminar for kids to educate them on the use of drugs
and consumption of alcohol, in particular the side effects and what kind of negative activity
it can lead to.
Commissioner McCoy asked if a child is sent to serve community service, what organization
will subsequently be holding them accountable. Ms. Guzman gave an example of how an
organization would verify the hours. She added if a child served their community hours at
the WV Pantry, then at the end of their time served the workers from the pantry will have to
sign off on their slip. Commissioner Huang also asked about the medication that contains
alcohol as the ordinance makes medicine an alcoholic beverage subject to ordinance rules.
He further added that he would like to see language similar to the definition of “Controlled
Substance” as the definition has a provision which allows for use of a substance with a
prescription.
Ms. Guzman responds it depends on the consumption of the medication . As an example, is
the kid taking medication for an illness or was it consumed at a party and multiple kids are
having the same symptoms. Those actions would be something that would have to be taken
into consideration when the situation arises.
Commissioner McCoy asked Captain Urena about his thought on this topic. Captain Urena
explained how the proposed amendments from the Teen Commissioners are great ideas and
fully supports them.
Commissioner McCoy motions to approve with amendments. Commissioner Nellore
seconds the motion. Ayes: Huang, McCoy, Sahai, Nellore, Chao. Noes: None. Abstain: None.

7. Subject: Report by Santa Clara County Fire District
Recommended Action: Receive Report by Santa Clara County Fire District
Fire Chief Justice reports that the stats for the month of January were not ready yet. He further
explained that they did have a fire at the Downtown Main Street Hotel where a guest was
using a hot plate to cook and happened to forget he was using the plate. The plate caught
fire and caused several hundred dollars in damage. Another fire was at the AMC Theaters at
Vallco Mall when a big deep fryer caught fire.
Last, Chief Justice explained a residential fire in the Kelly pocket of Cupertino near
280/Foothill. In that particular fire, the resident was able to get out unharmed due to being
alerted by his fire detector. The fire caused significant damages to his structure.
8. Subject: Report by The Santa Clara County Sheriff’s Office
Recommended Action: Receive Report by The Santa Clara County Sheriff’s Office
Captain Urena reported on response times for the month of January and all response times
were met. The Sheriff’s Office had one robbery, nine residential burglaries which compared
to 16 the year prior. Captain Urena continued to explain how the Sheriffs’ Office has been
busy with vehicle burglaries. In regards to vehicle burglaries, in the month of January The
Sheriff’s Office investigated 50, which are up compared to last year when the city only had
13 for the month of January.
Captain Urena added that a large amount of groups are causing these crimes. The groups
are coming from other bay area cities into our city for the purpose of committing these crimes.
Captain Urena further explained they are happening more in shopping centers and how he
has deployed deputies in unmarked cars watching these shopping centers.
Recently, deputies watching a shopping center apprehended several suspects coming out of
Walgreens after stealing bags of cosmetics.
Commissioner Nellore asked if the Sheriff’s Office is also tracking abandoned cars. Captain
Urena explained that the Sheriff’s Office does respond to these types of calls because they are
sometimes abandoned stolen cars.
Commissioner Huang inquired if Captain Urena needs additional resources now that the
Apple Campus is up and running. Captain Urena stated it is too early to say what impact
the new campus will have, other than obviously more traffic congestion. He added that the
need for more resources will be evaluated once enough data is available.

Lastly, Captain Urena explained The Crest Awards nomination process for 2018. He
explained the nomination period is now open with a due date of February 28, 2018. He
explained Commissioners cannot nominate themselves but can nominate someone that has
made a great impact to the city.
Commissioner Chao asked Captain Urena if he had more background on domestic violence
calls, Captain Urena explained that the specifics of domestic violence are not released to the
media due to the nature of the events. However, he explained that he can certainly provide
general details during the next meeting but nothing specific.

Commissioner McCoy explained he attended the Bike Pedestrian Committee meeting and
added that they are still in the drafting stage.
Ms. Guzman provided an overview of the Commission budget to the Commissioners.

Each year the City of Cupertino presents its CREST Awards, “Cupertino Recognizes Extra
Steps Taken,” to honor the outstanding contributions of Cupertino community members. The
2018 CREST Awards will be presented by the Cupertino Mayor and City Councilmembers on
Wednesday, May 30, 2018 at the Cupertino Community Hall, 10350 Torre Avenue.

Deputy Jonathon Lau #2232
Deputy Lau joined the Sheriff’s Office in April of 2014. Deputy Lau worked in the Courts division for a
short time before going to the Field Training Program (FTP) in 2016. Deputy Lau completed the FTP in
the middle of 2016 and was sent back to the Courts division. In January of 2017, Deputy Lau was
selected to work in the West Valley Patrol division where he remains. Deputy Lau has proven to be a
valuable asset to the division through his hard work. Deputy Lau is fluent in Mandarin and he is in high
demand.
In February 2017, Deputy Lau was on patrol in the city of Cupertino looking for suspicious activity.
Deputy Lau was driving down Stelling Road at Seven Springs when he noticed a 3 people running from
the back yard of a residence and into a waiting vehicle. Deputy Lau initiated a stop on the vehicle and it
pulled over. As Deputy Lau was walking up to the vehicle, it sped away at a high rate of speed. Deputy
Lau gave chase but was called off by his supervisor. A few minutes later Deputy Lau located a vehicle
accident in Saratoga that involved the vehicle he was chasing. All the occupants had fled the scene. A
search of the area resulted in an arrest of one of the suspects and recovering stolen property from a
residential burglary in Cupertino and Sunnyvale. The next day, the other 2 suspects were arrested due
to the information Deputy Lau recovered in the suspect vehicle.
In early March, Deputy Lau was dispatched to a winery off of Montebello Road and Stevens Canyon for 2
people breaking into vehicles. Deputy Lau was given the suspect vehicle description and located the
vehicle while in route to the scene. Deputy Lau gave chase and the suspect vehicle rammed him causing
him to terminate the pursuit. However, the suspect vehicle was located 3 days later by another police
agency and some of the victims property was recovered and returned to the victims.
In late November, Deputy Lau responded to a residential burglary in progress off of Farallone Drive. As
he arrived, the suspects were getting into a waiting vehicle. Deputy Lau tried to stop the vehicle but it
sped off. Deputy Lau gave chase but the suspects were driving too recklessly to continue the pursuit.
Based on the information Deputy Lau collected about the suspect vehicle it was located later that day
with some of the victim’s property in the back seat and 3 suspects were arrested.
Deputy Lau shows up each and every day to serve the people of this community. During every
interaction with the public Deputy Lau strives to serve as a role model for others within the agency to
follow. Whether he is stopping criminal activity, interacting with the community over a traffic concern,
or helping out at a neighborhood function, Deputy Lau always gives his best.

Steps Taken,” to honor the outstanding contributions of Cupertino community members. The
2018 CREST Awards will be presented by the Cupertino Mayor and City Councilmembers on

Deputy Marshall has been employed by the Sheriff’s Office for nine years and got his start on the
custody side. He has been assigned to WVP for the past for years beginning in 2014. During the last
calendar year investigated numerous cases in a very busy beat. The following are two of his most
notable cases.
On 02-09-17 at 1738 hours, Deputy Marshall contacted an RP over the phone who advised he was trying
to recover his stolen bicycle from a subject, who was selling it on "Offer Up". The RP previously
attempted to report the theft, but forgot his serial number. A subject showed up to the meeting area,
Starbucks at Cupertino Village on another bicycle and he was identified as ALTERMAN TROY ANTHONY
D3928211 DOB:04-29-1987, who Deputy Marshall was familiar with.
Deputy Marshall contacted Alterman's girlfriend and used his interpersonal skills to get her to
cooperate. She revealed where Alterman stored several bicycles. Deputy Marshall recovered 4 bicycles
hidden in the bushes along Hwy 280 west of Wolfe. One of the bicycles was the RP's so it was returned
to him. The bicycle was the RP’s only form of transportation and recently moved to the area from the
east coast. The RP was ecstatic at the speed and success of the recovery.
On 06-06-17, Deputy Marshall observed a car load of suspicious subjects drive into the Main Street
Cupertino shopping center. The subjects fit a M/O of auto burglars and they tried to elude him. Deputy
Marshall informed his beat partners of what he had and coordinated their response to the scene. With
his organization his team was able to contact and detain the three subjects that exited the vehicle.
Deputy Marshall developed probable caused based on his experience and searched the suspect vehicle,
recovering unreported stolen property. His investigation lead him to locate a victim and lead to the
arrests of the three individuals. One of the subjects was a known notorious auto burglar that we were
searching for over two months and previously eluded us. The suspect was also wanted by Sunnyvale and
Santa Clara PD for auto burglaries that possibly numbered over 100. This on-view arrest of a chronic
auto burglar was the second one for Deputy Marshall in less than a year. He had previously arrested
another subject that committed multiple auto burglaries in Cupertino over a two week span.
Deputy Marshall is also a leader on his team; he serves as a Field Training Officer for the Sheriff’s Office
training new deputies to be competent in the field, and is looked to by his peers for guidance and
mentoring. Deputy Marshall dons his uniform every day to serve this community to the best of his
ability, striving to make this community the safest it can be.
