Reso 5030Cl C/ CITY OF CUPERTINO 1 -GPA -99 10300 Torre Avenue Cupertino CA 95014 RESOLUTION NO. 5030 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING CITY COUNCIL APPROVAL OF A GENERAL PLAN AMENDMENT FOR TRANSITIONAL HOUSING SITES SECTION 1: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino has considered an amendment to the Land Use Element of the General Plan, reviewing potential changes to land use designations to ensure neighborhood compatibility for certain transitional areas throughout the community; and WHEREAS, a duly noticed public hearing was held on March 22, 1999, before the Planning Commission; WHEREAS, the Planning Commission finds that the proposed General Plan amendment meets the following: (a) The proposed General Plan Amendment will not have a substantial adverse affect on health or safety or be substantially detrimental to the public welfare or be injurious to property or public improvements; (b) The proposed change of General Plan land use designations for the transitional areas is consistent with all other goals, policies and implementing programs set forth in the Cupertino General Plan; (c) The proposed General Plan Amendment would serve to further Land Use Element Policy: "Enhance and protect the integrity of residential neighborhoods," by promoting housing types and densities on the transitional sites consistent with surrounding housing types and densities; (d) The proposed General Plan land use designations would not have a significant or measurable effect on the City's ability to meet affordable housing gals and objectives. NOW, THEREFRE BE IT RESOLVED That after careful consideration of the facts, maps, exhibits, testimony and other evidence submitted in this matter, the following proposed General Plan Amendment is hereby recommended to the City Council for approval: 1) Amend the General Plan land use designation from "Medium/High Density Residential" to "Medium/Low Density Residential" for the 1.l 5- Resolution 5030 1 -GPA -99 March 22, 1999 Page 2 acre site generally located on the east side of Poppy Way, south of Rainbow Drive (APN 366-19-048); 2) [No majority Planning Commission recommendation was made regarding parcels located on the east side of Gardenside Lane, southwest of Route 85 along Cleo Lane]; 3) Amend the General Plan land use designation west of Bianchi Way, south of Stevens Creek Boulevard east of Stelling Road from "Medium Density Residential' to "Commercial/Office/Residential" to be consistent with the Heart of the City Specific Plan (APNs 359-07-002, -003, -004, -009, -015, -017) 4) Amend the General Plan land use designation on the north side of Bollinger Road, east of DeAnza Boulevard from "Medium/High Density Residential" to Medium/Low Density Residential" (APN 369-37-022) The recommended General Plan land use changes are shown on Attachment 1. That the subconclusions upon which the findings specified in this resolution are based and contained in the public hearing record concerning Application No. 1 -GPA -99, as set forth in the Minutes of the Planning Commission meeting of March 22, 1999, and are incorporated by reference as though fully and set forth herein.
