Reso 2607 • 4-U-BS • RESOLUTION NO. 2607 • OF THE PLANNING COMMISSION OF THE CITY OF CUPE_RT I NO URECOMMENDING APPROVAL OF A USE PERMIT TO ENLARGE THE BAR AREA AND INCREASE THE SEATING IN THE BAR OF THE EXISTING RED COACH RESTAURANT. • APPLICANT: Sneaker' s of Northern California (Vailco Park, Ltd) ADDRESS: 347 East Campbell Avenue, Campbell , California 95008 SUBMITTED: January 16, 1985 LOCATION: Vallco Village Shopping Center at the northwest corner of Wolfe Road and Pruneri dge Avenue. • FINDINGS AND SUBCONCLUSIONS: Approval is subject to the findings as set forth on Page 1 and the subconclusions as set forth in the minutes of the Planning • Commission meeting of February 11 , 1985. CONDITIONS: • 1-15. STANDARD CONDITIONS Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special Sconditions as enumerated herein shall apply. 16. APPROVED EXHIBITS That the recommendation of approval is based on Exhibits A, A-1 , A-2 and B of Application 4-U-85 except as may be amended by special conditions enumerated herein. 17. APPROVED USES AND INTENSITY Approval is granted to allow operation of .a restaurant/bar not to exceed 16, 000 sq. ft . with a maximum of 143 seats located in the bar area, 115 seats located in the dining area of the first floor and a maximum of 225 seats allowed in the banquet rooms at the second floor. Hours of operation are limited between the hours of 6 a.m. and 2 a. m. The dance floor is limited to an area of 20 ft. by 18 ft. (360 sq. ft. ) as illustrated on Exhibit A-1 of Application 4-U-85 dated 1/16/85. Entertainment may include utilization of a large screen T. V. , and/or may include live music and dancing provided that noise from the entertainment function is not audible outside of the restaurant/bar facility. • • CITY OF CUPERTINO City Hall, 10300 Torre Avenue Ill Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING APPROVAL OF A USE PERMIT WHEREAS, the Planning Commission of the City of Cupertino received an application for a USE PERMIT, as stated on Page 2; and WHEREAS, the applicant has met the burden of proof required to support said application; and WHEREAS, the Planning Commission finds that the application meets the following requirements: a. That the use or uses are in conformance with the general plan and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b. That the property involved is adequate in size and shape to accommodate the proposed use. c. That the proposed use will not generate a level of traffic over and beyond that of the capacity of the existing street system. d. That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of such proposed use nor injurious to property and improvements in the neighbor- hood. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits and other evidence submitted in this matter, the application of the USE PERMIT is hereby recommended for approval, subject to the conditions stated on Page 2; and BE IT FURTHER RESOLVED: That the aforementioned findings be approved and adopted, and that the Secretary be, and is hereby directed to notify the parties affected by this decision. Free-standing signage or pedestrian mounted signage shall be subject to further review upon submittal of the exhibits to the Architectural Committee consistent with the requirements of the Sign Ordinance. 19. PA-RKING Parking for the Vallco Village Shopping Center Phase I is calculated at the following ratios: First floor restaurant/bar 258 seats : 1 sp/3 seats = 86 Second floor banquet rooms 225 seats : 1 sp/4 seats = 56 Employees maximum shift 20 employees = 2C� Pizza Wiz Restaurant 49 seats : 1 sp/4 seats = 12 6 employees = 6 Retail Space 78, 616 sq. ft. : 200 = 797; TOTAL REQUIRED = 573 TOTAL PROVIDED = 572 DEFICIT = 1 The Sneaker' s Restaurant/Barg Pizza Wiz Restaurant and Retail Space in Vallco Village Shopping Center Phase I will utilize all of the currently available parking.
