PC Reso 1614 27-TM,76 RESOLUTION NO, 1614 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE • 20.84 ACRES INTO FORTY-THREE (43) LOTS. Box 1271, San Carlos, California 94070 SUBMITTED: October 27, 1976 LOCATION: Southerly of and adjacent to Voss Avenue at its westerly terminus ACREAGE: 20.84 acres -------------- CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15, That the approval is based upon Exhibits A and B of Application 27-TM-76, as may be modified by additional conditions contained herein. 16. The grading for the public street, driveways and sites shall be sub- stantially as shown on Exhibit A. Architectural plans including pro- posed lot grading, drainage, and building morphology, shall be submitted to the Architectural and Site Approval Committee for review prior to issuances of a building permit for any construction on Lots 1-5, and Lots 29-43. The Architectural and Site Approval Committee shall review • said plans with the intent that grading and fencing plans result in. minimum disruption of the natural setting of the site. In order to permit migration of wildlife and to retain the natural open character of the hillside area for said lots, solid fencing shall be limited to a building envelope. Fencing may be permitted outside of the building envelope subject to approval by the Architectural and Site Approval Committee. 17. A minimum of .15 feet of slope rounding shall be provided at the top of all cut banks. 18. The applicant or subsequent building permit applicant shall retain a registered landscape architect to review the proposed grading and sub- mit a plan to replant all cut and fill slopes, preferably with indigenous vegetation, 19. Adequate turn-around spaces and four off-street parking spaces shall be provided on each lot served by the 24-ft. street to compensate for the lack of public street parking and provide space for emergency equipment. 20. The applicant shall record a covenant on each lot to be transferred, informing future lot purchaser of the existence of geologic hazards in..: the area, and additionally, that special development regulations apply to any construction on the lot, as set forth in this resolution as may • be amended in thefuture. The 75 ft. fault zone setback line shall be recorded in a manner approved by the City Engineer. . -2- CITY • OF CUPERTINO City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A TENTATIVE MAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative map; and WHEREAS, the Planning Commission has held at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings: a) That the proposed map is consistent with the general and specific411 plans. b) That the design or improvement of the proposed subdivision is consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. -1- 27rTM-76- Resolution No. 1614 (continued) • 21. Prior to recordation of the final map, the applicant shall retain an engineering geologist to evaluate the western section of the site to determine the extent of geologic risk to development. If the geologic investigation concludes that one or more of the proposed lots or the public streets are subject to unmitigable geologic risks, the tentative map shall be reevaluated by the Planning Commission to determine appro- priate steps to reduce the potential risk, 22. The pond on the northern boundary of the site shall be retained and dedicated by the developer/owner to a public or private agency/group interested in maintaining the pond as a natural resource area. If no entity agrees to accept dedication, the pond area can be incor- porated into either Lots 1, 2, .40 or 41 or all lots. The lot line amendment shall be subject to approval of the City Engineer. The developer shall submit the pond reservoir removal and site restoration plans to the Planning Commission for approval. The final decision for acceptance or dedication of the pond by a public agency or private group shall be made prior to acceptance of public improvements or occupancy of dwelling units, whichever comes first. The development right of the pond site shall be dedicated to the City of Cupertino to preclude urban development from occurring on the site. SThe developer/owner shall complete the repair work to the dam spillway, as described in the March 197.6 Soil Foundation Systems, Inc. report entitled "Stability Study Report for existing Dam, Alcalde Knolls, Cupertino, California". 23. The developer/owner::shall complete street improvements to the terminus of Voss Avenue and Alcalde Road in a manner approved by the City Engineer. 24. A public pedestrian easement shall be recorded providing access between the pond referenced in Condition 22 and Voss Avenue. The specific loca- tion shall be approved by the City Engineer. If the pond is not acquired by a public agency and the pond area is divided and included in the lots referenced in Condition 22, the easement shall not be required. 25. The right of way for "Street E" shall be extended to the western boundary of the property in a= location as approved'by the City Engineer. The owner/ developer is not responsible for subsequent improvements for the.:50+ foot extension of the public right of way. . 26.
