OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
411 RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW CON=
STRUCTION OF A PROFESSIONAL OFFICE BUILDING CON-
TAINING APPROXIMATELY 10,700 SQ. FT.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of December 12, 1977.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. The application is based upon Exhibit A of Application 35-U-77 as may
® be amended by additional conditions contained herein.
16. The approval includes a concept of dividing the 10,672 sq. ft. +
building area into two to eight air space condominium professional
offices and related commercial building units. The applicant shall
obtain Planning Commission approval prior to dividing the building
space into more than eight individual air space units.
17. An association comprised of all condominium owners shall be formed
to ensure proper management of commonly held property. The appropriate
association document shall be reviewed and approved as to form and
content by the City Attorney prior to recordation of the final map.
18. The applicant shall enter into an agreement with the City of Cupertino
and directly affected property owners bordering the property to con-
struct on-site and off-site improvements deemed necessary by the
Director of Public Works to make the subject application function
effectively in terms of the interconnecting of utilities and
vehicular circulation.
19. The applicant shall sign an agreement with the .City which is acceptable
to the City Attorney agreeing to provide reciprocal parking and ingress/
egress easements to the properties within the Bryan Terrace development
and the adjoining property to the west and northwest, at such time as
the City can require the same of said property owners.
410 20. The building and parking lot setback from the Pacifica Drive right of
way line shall be a minimum of 25 ft.
