Approval is recommended subject to the findings as set forth an
Page I and subconclusions as set forth in the minutes of the
Planning Commission meeting of April 11, 1984.
CONDITIONS.OF APPROVAL
1-14. Standard Conditions
Standard Conditions to the extent that they do not conflict
with the special conditions contained herein. In the event
a conflict does exist, the special conditions as enumerated
herein shall apply.
15. AQUEgygd-Uses
The uses may include general, administrative, industrial
administrative offices but shall specifically preclude
manufacturing uses. All new uses or change in use which
are not reflective of the office uses specified above shall
require use permit review as determined by the Director of
Planning.
Prototype research and development activity is permissible
if conducted in consort with office functions of a business
establishment. Prototype "R and D" activity shall be
regulated in accordance with guidelines specified in the
General Plan.

The applicant shall record a covenant agreeing to enter
into reciprocal ingress/egress easements with the adjoining
commercial center to the south across the parking area an
Site B. The City has a similar agreement placed on the
approval of an application on.the adjoining center.
Installation of the ingress/egress driveway shall not take
place unless and until Silverado Avenue is closed off at
the southerly property line of the subject property,
thereby separating the residential area from intrusion by
commercial traffic.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has been submitted to the City
of Cupertino requesting a change of zone in the zoning regulations
of the City, as stated on Page 2: and
WHEREAS the Planning commission has held at least one public
hearing in regard to the application on the date as noted on
said application; and
WHEREAS the Planning commission has duly considered and heard
all evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as required
by the Zoning ordinance of the City of Cupertino:
NOW, THEREFORE, BE IT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a. Encourages the most appropriate use of land.
b. Conserves and stabilizes the value of property.
C. Provides fcr adequate open spaces for light and air.
d. Permits adequate control of fires.
e. Promotes the health, safety and pub1ci welfare.
f. Provides for the orderly development of the City.
g. Is advantageous to the property and improvements in the
zoning district and neighborhood in which the property
is located.
That said Planning Commission, therefore, reports favorably to the
City Council in the matter of granting said zone change.
