RECOMMENDING DENIAL OF REZONING APPROXIMATELY 1.19

DEVELOPMENT WITH GENERAL COMMERCIAL INTENT) ZONE.

FURTHER FINDINGS:
That the conceptual development plan is not compatible with the surrounding
neighborhood because of the following reasons: .
1. That the use would increase traffic during the peak hour and other hours
of the day that will create undue and unreasonable traffic congestion
in the area.
2. That the proposed 24-hour restaurant is incompatible with the neighborhood
because of its noise 'factor.
3. That the proposed 24-hour restaurant may result in an increase of incidents
® of socially deviant behavior.
PASSED AND ADOPTED this 22nd day of November, 1976, at a regular meeting of
the Planning Couuuission of the City of Cupertino, State of California, by
the following roll call vote:

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
DENYING THE GRANTING OF A ZONEIICHANGE
WHEREAS The attached application has been submitted to the
City of Cupertino requesting a;'; change of zone in the zoning
regulations of the City, as stated on Page 2, and

WHEREAS The Planning Commission has held at least one public
hearing in regard to the appli "cation on the date as noted on
said application; and
WHEREAS The Planning Commission has duly considered and heard
all evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as re-
quired by the zoning ordinance;! of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED :
1 . That the Planning Commission finds that the proposed
zone change does not meet all of the following require-
ments : !! •
a. Encourage the most, appropriate use of land,
b . Conserve and stabi,l "ize the value of property,
c. Provide for ' adequa,te open spaces for light and
air,
d. Permit adequate control of fires ,
e. Promote the health, safety and public welfare,
f. Provide for the orlderly development of the City,
g. Be advantageous to, the property and improvements
in the zoning district and neighborhood in which
the property is ldlcated.
