OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE APPROVAL OF A CHANGE OF ZONE FOR
1.6 ACRES FROM A1-43 (AGRICULTURAL-RESIDENTIAL, SINGLE-
411 FAMILY, 1-ACRE LOTS) TO BQ (QUASI-PUBLIC BUILDING)
ZONE.

ZONE: A1-43 (Agricultural-Residential, single-family, 1-acre lots) •
ACREAGE: 1.6 acres
CONDITIONS :
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. That the ultimate development of the subject property shall reflect the
site plan as indicated on Exhibit B-2 1st Revision. The site and
architectural plats for the phasing of construction as indicated on
Exhibits B 1st Revision, B-1 1st Revision and B-2 1st Revision shall be
reviewed by the Architectural and Site Approval Committee as each phase
is ready for development.
® 16. The parking needs of the subject development, as determined by the uses
and activities described by the applicant, shall be limited to 150 spaces.
The parking shall be provided on the subject property as indicated on
Exhibit B-2 1st Revision and on the Vallco Village Shopping Center property
as per the exchange agreement between Vallco Park, Ltd. and the Good
Samaritan Church entered into on February 7, 1966 .
In the event that the parking needs for the church expand due- to a change
in activities or uses, the proposed changes shall be subject to use permit
approval by the Planning Commission.
17.. That the uses permitted on the subject property shall be limited to those
directly associated with the religious organization as follows :
a.. Services , conventions and seminars customarily associated with churches .
b. Sunday School or other religious classes for adults and children.
c. Day care for small infants and children only in conjunction with
religious activity taking place elsewhere on the property.
d. Socials, weddings, recreation and special programs customarily
associated with church activities.
e. Any other uses of a similar nature as those listed which in the
® opinion of the Planning Director are compatible.

ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has been submitted to the City of
Cupertino requesting a change of zone in the zoning regulations of the
City, as stated on Page 2; and
WHEREAS- the Planning Commission has held at least one public hearing
in regard to the application on the date as noted on said application;
and
WHEREAS the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as required by
the Zoning ,Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a) Encourages the most appropriate use of land,
b) Conserves and stabilizes the value of property,
c) Provides for adequate open spaces for light and air,
d) Permits adequate control of fires,
e) Promotes the health, safety and public welfare,
f) Provides for the orderly development of the City,
g) Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located. --
That said Planning Commission, therefore, reports favorably to the City
Council in the matter of granting said zone change.

18. Uses other than those enumerated in Condition 17 shall be subject to
use permit approval as provided in Section 130.1 of Ordinance 220(i) .
19. A master landscaping plan shall be reviewed by the Architectural and
Site Approval Committee and approved by City Council in conjunction
with the Architectural and Site Approval Committee approval of the
initial construction phase. The major trees designated on the
approved master landscaping plan shall be planted in conjunction with
the initial construction phase.

the Planning Commission of the City of Cupertino, State of California, by
the following roll call vote:
