Reso 1670 4-Z-77 RESOLUTION NO. 1670 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A REQUEST TO REZONE APPROXIMATELY 2.55 ACRES FROM CG (GENERAL COMMERCIAL) TO P (PLANNED DEVELOPMENT WITH COMMERCIAL AND PROFESSIONAL OFFICE USE INTENT) . APPLICANT: Pacific Valley Bank ADDRESS : 1245 S. Winchester Blvd. , San Jose, California 95128 SUBMITTED: February 8, 1977 LOCATION: Northeasterly quadrant of North De Anza Blvd. and Stevens Creek Blvd. ACREAGE: 2.55 acres CONDITIONS : 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That this approval is based upon Exhibit A of 4-Z-77, Exhibit B of 4-Z-77 and 5-U-77, Exhibit C and D of 5-U-77, as may be modified by additional conditions presented herein. 16. The land use intensity shall be limited to an intensity that will ® not generate more than 16 one-way trips per acre during the peak traffic hour. For the purpose of the 16 one-way trip traffic intensity performance standard, the following accounting of trips is hereby incorporated into the project approval: Trips Generated by the Project Phase I Bank - 4,000 sq. ft. x 7.0 = 28 Office - 6,000 sq. ft. x 1.0 = 6 Phase II Office - 7,000 sq. ft. x 1.0 = 7 Total 41 Allowable Trips = 2.55 acres x 16 = 41 Surplus Trips = 0 17. The applicant shall sign a statement with the City which is acceptable to the City Attorney, agreeing to provide reciprocal parking and ingress/ egress easements to the properties designated on tentative parcel map 110 2-TM-77 as owned by National Life and Accident Insurance Company, and Baer Property (see Exhibit A of Application 2=TM-77) at such time as the City can require the same of said property owner/s. -2- n 4-Z-77 Resolution No. 1670 (continued) • . Additionally, the agreement shall state that the applicant will provide III reciprocal parking and ingress/egress easements with the adjoining Catholic Church property at such time as the owner of the St. Joseph's Catholic Church dedicates and/or improves the church frontage along North De Anza Boulevard and agrees to provide reciprocal parking and ingress/egress easements to the applicant. The agreement should state that it is understood that said easements are to be mutually agreeable to both parties. The precise location of said ingress/egress easements with the Church property to the north and east shall be determined and based upon future negotiations concerning an enlarged right-of-way area and the most logical location of major driveway entrances off of said right-of-way. 18. This approval is for a two-phase project which includes a 10,000 sq. ft. building in Phase One consisting of 4,000 sq. ft. devoted to a bank tenant, and 6,000 sq. ft. for general office uses, and a 7,000 sq. ft. office building in the Phase Two portion of the development. It is understood that the Phase Two portion of this project will incorporate 1 architecture styling which is similar to the architectural theme pro- posed on the bank/office structure of Phase One. In addition, the applicant shall provide a 50 ft. landscape setback from Stevens Creek Boulevard in which no circulation or parking shall be permitted. It is permissible to allow the building to encroach into the 50 ft. land- scape setback provided that the overall landscaping area totals 50 sq.ft. times street frontage. It is anticipated that a site plan change may be necessary to accommodate the above provisions, and that the Architec- tural and Site Approval Committee shall have the ability to make 411 changes in the site plan to accommodate the above provisions and to provide for a more logical circulation system.
