Reso 42038-Z-89 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION No. 4203 OF T11E PIANNING COMMISSION OF TELE CITY OF C1JPERTINO RDOOIMUNDING APPROVAL OF REZONING OF ONE LOT OF 4.0 ± ACRES IN 'DIE BA (PUBLIC BUILDING) TO R1-6 (RESIDENTIAL SINGLE-FAMILY, 6,000 SQ. FT. MINIMUM LOT SIZE) SECTION 1• FINDINGS WHEREAS, the Planning Commission of the City of Cupertino has received an application for a change of zone or prezoning, as described on Page 2 of this Resolution; and WHEREAS, the necessary public notices have been giver in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more Public Hearings on the subject application; and munrAS, the Planning Commission finds that the subject change of zone or prezone meets the following requirements: 1) Encourages the most appropriate use of land 2) Conserves and stabilizes the value of property. 3) Provides for adequate access to light and air. 4) Permits adequate control of fires. 5) Protects public health, safety and welfare. 6) Promotes the orderly development of the City. 7) Benefits the property and improvements in the zoning district and neighborhood in which the property is located. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence sutmitted in this matter, the application for Change of zone or prezone is hereby recommended for approval; and BE IT FUlZrH R RESOLVED: That the subconclusions upon which the findings and conditions specified in this Resolution are based upon are contained in the Public Hearing record concerning Application 8-Z-89 as set forth in the Minutes of the Planning Commission meeting of September 11, 1989, and are incorporated by reference as though fully set forth herein.
