Reso 41624-Z-89 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4162 OF THE PLANNING CCM4ISSION OF THE CITY OF CUPERTIN0 REOOMhfMING APPROVAL TO REZONE A PARCEL FRCH R1-10 (SINGLE-FAMILY RESIDENTIAL) TO F41S (RESIDENTIAL HILSSIDE) AS DESCRIBED ON EXHIBIT A OF APPLICATION 4-Z-89 SECTION 1: FINDINGS WHEREAS, the Planning Camnission of the City of Cupertino has received an application for a change of zone or prezoning, as described on Page 2 of this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Cc mnission has held one or more Public Hearings on the subject application; and WHEREAS, the Planning Commission finds that the subject change of zone or prezone meets the following requirements: 1) Encourages the most appropriate use of lanai. 2) Conserves and stabilizes the value of property. 3) Provides for adequate access to light and air. 4) Permits adequate control of fires. 5) Protects public health, safety and welfare. 6) Promotes the orderly development of the City. 7) Benefits the property and improvements in the zoning district and neighborhood in which the property is located. NOW, THEREFORE, BE IT RESOLVED: 'That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for change of zone or prezone is hereby recc mnended for approval; and BE IT FURTHER RESOLVED: That the subconclusions upon which the findings and conditions specified in this Resolution are based upon are contained in the Public Hearing record concerning Application 4-Z-89 as set forth in the Minutes of the Planning Commission Meeting of May 22, 1989 arra are incorporated by reference as though fully set forth herein.
