SECTION I. FINDINGS
WiM;nS, the Planning Commission of the City of Cupertino has received an
application for a charge of zone, as described on Page 2 of this
Resolution; arra
WHEREAS, the necessary public notices have been givers in accordance with
the Procedural Ordinance of the City of Cupertino, and the Planning
Commission has held one or more Public Hearings on this matter; and
WHEREAS, the applicant has failed to meet the burden of proof required to
support the application, and has not satisfied the following requirements:
1) She proposed change of zone encourages the most appropriate use of
land
2) She proposed change of zone conserves and stabilizes the value of
property
3) She proposed change of zone provides for adequate light and air
4) She proposed duva ge of zone provides for adequate control of fires
5) She proposed change of zone promotes the health, safety and general
welfare of the commmmity.
6) She proposed orange of zone provides for the orderly development of
the City. _.
7) Rhe proposed change of zone is advantageous to the property and
improvements in the zoning district and neighborhood in which the
subject site is located.
WHEREAS,
1) Use of the R1 zone is not consistent with hillside goals of the
City.
2. She Proposed rezoning represents spot zoning.
NOW, RFOEFORE, BE IT RESOLVED
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the Planning Comissien hereby
recommends denial of the subject application for change of zone by the
City Council of the City of Cupertino; and

That the subconclusions upon which the findings specified in this
Resolution are based are contained in the Public Hearing record concerning
Application 6-Z-87 as set forth in the Minutes of the Planning Commission
meeting of August 10, 1987 and are incorporated by reference as though
fully set forth herein.
