WHEREAS, the Planning r—issioQn of the City of Cupertino has received an
application for a change of zone or prezcning, as described on Page 2 of
this Resolution; and
wi F , the necessary public notices have been given in accordance with
the Procedural Ordinance of the City of Cupertino, and the Planning
Coanmission has held one or more Public Hearings can the subject
application; and
wHEREAS, the Planning Commission finds that the subject change of zone or
prezone meets the following requirements:
1) Encourages the most appropriate use of lard
2) Conserves and stabilizes the value of property.
3) Provides for adequate access to light and air.
4) Permits adequate control of fines.
5) Protects public health, safety and welfare.
6) Promotes the orderly development of the City.
7) Benefits the property and iuVrovements in the zoning district and
neighborhood in which the property is located.
NOW, ARE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for change of
zone or prezone is hereby recceended for approval; and
BE IT FUMBER RESOLVED:
That the subeonclusions upon which the findings and oorxliticns specified
in this Resolution are based upon are contained in the Public Hearing
record concerning Application 8-Z-86 as set forth in the Minutes of the
Planning rntmssionn meeting of February 9, 1987, and are incorporated by
reference as though fully set forth herein.

conditions em=exated herein.
Exhibits A-1 and B shall constitute the "Wvel.opment Plan" required
under Section 14 of Ordinance No. 664.

The subject zoning approval authorizes construction and occupancy of
a maximum of three (3) condominium dwellings and related site
improvements to be constructed in a single phase. Said construction
shall proceed in accordance with the terms of this Resolution, and
in accordance with the provisions of the approved Development Plan.

In the event that the developer shall desire to make any amendment
of the approved Development Plan subsequent to granting of the
rezone to R1 -C, the procedures specified in Section 16 of ordinance
664 shall be followed.
4. ARCHrrECIURAL REVIEW
Prior to issuance of building permits, the developer shall submit
definitive landscaping, building elevation and site development
plans to the Architectural and Site Approval Committee (ASAC) for
formal review as required under Section 17 of Ordinance 664. The
developer shall accompany said submittal with a definitive color and
materials palette.

The ASAI sha11 have authority to amend Exhibits A-1 and B of this
rezone action to require enhancement of architectural interest and
to establish a greater degree of visual consistency between the
project's exterior materials and surrounding development.
The developer shall also suimit an offsite privacy impact surly for
the easterly elevation of the project, including a cross section
depicting views into the adjoining private patios of the adjacent
apartment r

5. PARI
Off street parking shall be provided at a ratio of four spaces per
dwelling unit, at least two of which shall be within an enclosed
garage for each dwelling unit.
The "guest" space in front of Unit 1 shall be eliminated, and a
hammerinead turnaround shall be provided opposite the driveway for
Unit 2. The final configuration of the hammerhead turnaround area
shall be subject to staff approval.
In accordance with section 13.4(a) of ordinance 664, the developer
shall provide a wingwa11 within the front yard of Unit 1 to screen
the principal entry to Unit 2.
7. PAD ELEVATION
Pad elevations shall not exceed 18" above the top of curb elevation
at the southwest corner of the site.

The applicant shall install plumbing chases to facilitate future
installation of roof mounted solar water heating devices.
Installation of said devices is optional.
The Homeowners Association documents, enabling declaration and
condominium plan shall be approved by the Department of Planning and
Development and by the City Attorney prior to recordation.
