RESOLDTION NO. 3041
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF AN AMENDMENT TO CONDITION
NO. 16 OF ZONING ACTION 2-Z-83 TO DELETE REFERENCE
TO 50,000 SQ. FT. OF COMMERCIAL USES WITHIN
THE PLANNED DEVELOPMENT COMPLEX.
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino has received an
application to modify conditions for a previously approved zoning
application (2-Z-83) , as described on Page 2 of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with
the Procedural Ordinance of the City of Cupertino, and the Planning
Commission has held one or more Public Hearings on the subject
application; and
WHEREAS, the Planning Commission finds that the subject change of zone or
prezone meets the following requirements:
• 1) Encourages the most appropriate use of land
2) Conserves and stabilizes the value of property.
3) Provides for adequate access to light and air.
4) Permits adequate control of fires.
5) Protects public health, safety and welfare.
6) Promotes the orderly development of the City.
7) Benefits the property and improvements in the zoning district and
neighborhood in which the property is located.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Change of
zone or prezone is hereby recommended for approval; and
BE IT FURTHER RESOLVED:
That the subconclusions upon which the findings and conditions specified
in this Resolution are based upon are contained in the Public Hearing
111 record concerning Application 2-Z-83 (Revised) as set forth in the Minutes
of the Planning Commission meeting of June 8, 1987, and are incorporated
by reference as though fully set forth herein.

SECTION III: CONDITIONS ALMaNISTERED BY THE PLANNING DEPARTMENT
1. PREVIOUS CONDITIONS
All previous conditions approved with Application 2-Z-83 shall remain
in full force and effect per City Council Action Letter dated July 26,
1983.
2. LAND USES
Condition 16 is amended to change the requirements to allow up to
50,000 sq. ft. of commercial uses. Said building area may be used for
office, industrial (consistent with limits expressed in the zoning
condition) and commercial uses at the option of the developer
111 consistent with an approved use permit on the property.
The first floor of office buildings shall be designed so as not to
preclude commercial uses consistent with the City's CG (General
Commercial) zoning ordinance.
PASSED AND ADOPTED this 8th day of June, 1987 at a Regular Meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
