PC Reso 1565 17-Z-76 RESOLUTION NO. 1565 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO 411 RECOMMENDING THE APPROVAL OF A CHANGE OF ZONE FOR APPROXI:IATELY 54 ACRES FROM P (PLANNED DEVELOPMENT WITH COMMERCIAL USE INTENT) TO P (PLANNED DEVELOPMENT WITH COMMERCIAL, INDUSTRIAL/OFFICE USE INTENT)ZONE. APPLICANT: Sobrato-Berg Properties ADDRESS: 2775 Middlefield Rd. , Palo Alto, California 94306 SUBMITTED: July 1, 1976 LOCATION: Easterly of and adjacent to North De Anza Blvd. and extending southerly from the intersection of North De Anza Blvd. and Route 280 for a distance of approximately 2500 ft. ACREAGE: 54 acres CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. Approximately 2.2 acres located within the northeast corner of the intersection of De Anza Blvd. and Mariani Ave. is designated for general commercial land uses with the balance of the zoning district designated for light industrial/office land uses. 16. Mariani Ave./Merritt Dr. shall be closed to through vehicular traffic. Both streets shall be cul-de-saced with a design and location to be determined in conjunction with subsequent use permit applications. Pedestrian and bicycle access through said street shall be maintained. There shall be no vehicular access from the zoning district to Merritt Drive or Lucille Avenue. 17. The properties directly fronting on North De Anza Blvd. shall provide a minimum 50-ft. landscape setback area from curb line or shall provide a landscaped area adjacent to North De Anza Blvd. with a varied depth with a minimum area equal to the lot frontage dimension multiplied times 50 ft. In no case, shall the setback distance be less than 35 ft. from curb line. Adams, Chairman Assistant Planning Director Planning Commission City of Cupertino California RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING THE GRANTING OF A ZONE CHANGE WHEREAS the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the City, as stated on Page 2; and WHEREAS' the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application; and WHEREAS the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS the necessary public notices have been given as required by the Zoning ,Ordinance of the City of Cupertino; NOW, THEREFORE, BE IT RESOLVED: That the Planning Commission finds that the proposed zone change: a) Encourages the most appropriate use of land, b) Conserves and stabilizes the value of property, c) Provides for adequate open spaces for light and air, • d) Permits adequate control of fires, e) Promotes the health, safety and public welfare, f) Provides for the orderly development of the City, g) Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. • -1-
