Reso 4029APPLICATION 27-TM-87 9 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4029 OF THE PLANNING DIRECTOR OF THE CITY OF CUPERTINO APPROVING A TENTATIVE PARCEL MAP TO CONSOLIDATE TWO PARCELS INTO ONE PARCEL SECTION Ie FINDINGS WI=EAS, the Planning Director of the City of Cupertino received an application for a Tentative Parcel Map, as describe on Page 2 of this Resolution, and W=2EAS, the necessary public notices have been given as required by the Subdivision and Procedural Ordinances of the City of Cupertino, and the Planning Director has held at least one Public Hearing in regard to the application; and WHEREAS, the Planning Director finds that the application meets the following requirements- a3 That the propose tentative parcel map is consistent with the City of Cupertino General Plan and with any applicable Specific Plano bj That the design or improvement of the propose consolidation is consistent with the General Plan and any applicable Specific Plana c3 That the site is physically suitable for the type and intensity of development contemplated under the approved consolidation. d) That the design of the consolidation or the propose improvements are not likely to cause substantial environmentaldamage nor substantially and avoidably injure fish or wildlife or their habitats e) That, the design of the consolidation or the type of improvements associated therewith are not detrimental to the health,` safety. - peace, morals and general welfare of persons residing or working in the vicinity of the consolidation. f) That the design of the consolidation and its associate improvements Will not conflict with easements acquired by the public at large for access through or use of property within the proposed consolidation. e 1 0 RESO=ION NO. 4029 (27-,TM-87) 12/28/87 Page - 2 - 14 NOW, THEREFORE, BE IT RESOLVED: That upon careful consideration of maps, exhibits, facts, testimony and other evidence submitted in this matter, the application for the Tentative Parcel Map is hereby approved, subject to the conditions enumerated in this Resolution beginning on this page; and BE IT FURTHER RESOLVED: That the subconclusicns upon which the findings and conditions specified in this resolution are based are contained in the Public Hearing record concerning Application 27-IM-87, as set forth in the Minutes of the Planning Director Meeting of December 28, 1987, and are incorporated by reference as though fully set forth herein. STPZEE.P IMPROVEMENTS & DEDICATION Street widening, improvements, and dedications shall be in accordance with City Standards and specifications and as required by the City Engineer (per Monta Vista Design Guidelines). 20 CURB, GUTS & SIDEW Curbs, gum, sidewalks, and structures shall be installed to grades arm to be constructed in accordance with standards (per Monta Vista Design Guidelines) as specified by the City Engineer. 3° LIGHTING Street l:i itLng (per Morita Vista Design Guidelines) shall be installed and 81 be as approved by the City Engineer. FIRE HYDRANTS Fire hydrants shall be located as re quired by the City. 5. TRAFFIC CONTROL SIGNS Traffic control signs will be placed at locations to be specified by the City. 6. STREET TREES Street trees shall be planted in the public right-of-way and shall be of a type approved by the City in accordance with the Monta vista Design Guidelines. 7. GRADING Grading shall be as approved and required by the City Engineer in accordance with ordinance No. 214(a)o. Pad height shall be set at the minimum height necessary consistent with City Standards, 8< DRAINAGE Drainage shall be to the satisfaction of the City Engineer. Surface flow across. ;public sidewalks may be allowed in Rl, R2, and R3 zoning unless storm '`drain facilities are deemed necessary by the City Engineer. All developments other than Rl, R2, and R3 zoning shall be served by on -site storm drainage- facilities connected to the City storm drainage system. If City storm drains are not available, drainage facilities- shall be installed to the satisfaction of the City; Engineer. 9. UNDERGROUND UTILITIES The applicant shall be responsible for complying with the requirements of the Underground Utility Ordinance No. 331 and other elated ordinances and regulations of the City of Cupertino, and shall make the necessary arrangements with the utility companies involved for the installation of said facilities. The applicant shall submit a detailed plan showing utility underground provisions. (This plan must have prior approval of theutilitycompanies and. the City Engineer.) 10a DEDICATION OF WATER LINES The developer shall delicate to the City all waterlines and appurtenances installed to City Standards and shall reach an agreement with Cupertino Water Utility for water service to the subject development. DEVELOPMENT AGRJEE� a The project developer shall enter into a development agreement with 'I the City of Cupertino providing for payment of fees, including but not limited to checking and inspection fees, storm drain fees, park dedication fees and fees for and oun en�r ding of utilities. Said agreement shall be executed prior to issuance of construction permits. SECTION IV: CONDITIONS AU=STERED BY THE PLANNING DEPARTM= 12. APPROVED EXHIBITS i That the approval is based on Exhibit A of Application 27-1IM-87 except as may be amended by additional conditions enumerated herein. 13. FUTURE INGRESS/EGRESS EASETMgT'S The applicant shall sign an agreement to participate in a reciprocal access easement with the adjoining property owners when said property owners are obligated to participate in a similar agreement. Said agreement shall provide access rights for all property owners within the area bounded by Stevens Creek Boulevard, Pasadena Avenue, Granada Avenue and Imperial Avenue. 14. MONTA VISTA pMNFENANCE DISTRICT Applicant shall agree to join a Monta Vista Commercial Area Assessment District to pay for maintenance and operation of public improvements including but not limited to street lights, public landscaped areas, street furniture, public parking areas, etc. APPROVED this 28th day of December, 1987, before the Director of Planning and Development of the City of Cupertino, State of California. .Robert S o Cowan Director of Planning And Development RES27`I3vI87 (Ql)
