RECOMMENDING APPFAVAL OF A TEh`IAATIVE MAP TO
SUBDIVIDE 1 PARCEL INTO 5 PARCELS WITH LOT
SIZES RANGING FROM 9,950 SQ. FT. TO 104,500 SQ. FT.
SECTION I: FINDINGS
WHEREAS, the Planning Cccmd ssicn of the City of Cupertino received an
application for a Tentative Subdivision Map, as described on Page 2 of
this Resolution; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and Procedural Ordinances of the City of Cupertino, and the
Planning Commission has held at least one Public Hearing in regard to the
application; and
WHEIMNS, the Planning Commission finds that the application meets the
following requirements:
a) That the proposed subdivision map is consistent with the City of
Cupertino General Plan and any applicable Specific Plan.
b) That the design or improvement of the proposed subdivision is
consistent with the General Plan and any applicable Specific Plan.
c) That the site is physically suitable for the type and intensity of
development contemplated under the approved subdivision;.
d) Mmt the design of the subdivision or the proposed improvements are
not likely are not likely to cause substantial environmental damage
nor substantially and avoidably injure fish and wildlife or their
habitat.
e) That the design of the subdivision or the type of improvements
associated therewith are not detrimental to the health, safety,
peace, morals and general welfare of persons residing or working in
the vicinity of the subdivision.
f) That the design of the subdivision and its associated imprvvenents
will not conflict with easements acquired by the public at large for
access through or use of property within the proposed subdivision.
That upon careful consideration of maps, exhibits, facts, testimony and
other evidence submitted in this matter, the application for Tentative
Subdivision Map is hereby recommended for approval, subject to the
conditions enumerated in this Resolution beginning on Page 2 thereof; and

That the suboonclusions upon which the findings and conditioms specified
in this Resolution are based are contained in the Public Hearing Record
concerning Application 25-M-87, as set forth in the Minutes of the
Planning Cormnission Meeting of January 11, 1988, and are incorporated by
reference as though fully set forth herein.

III. CONDITIONS AQMINISTERED BY THE PUBiIC WOMG DEPAKII�IP
1. STREET WIDENING
Street widening, inprovements and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.
2. CURB AND GUTTER IMPR7VE[4FNI5
Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards as specified by the City
Engineer.
3. SIREN LIGHTING INSTALLATION
Street lighting sha11 be installed and shall be as approved by the
City Engineer. Lighting fixtures shall be positioned so as to
• preclude glare and other forms of visual interference to adjoining
properties, and shall be no higher than the maximum height permitted
by the zone in which the site is located.
4. FIRE EiYIktANT
Fire hydrants shall be located as required by the City.
5. TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the
City.

Street trees shall be planted within the Public Right of Way and shall
be of a type approved by the City in accordance with Ordinance 125.

The final grading plan shall subject to approval by the City Engineer
in accordance with all applicable ordinances.
Fad Grade, driveway location and alignment, and the extent of cut and
fill slopes on Lot 5 of the subdivision shall confozm substantially to
their depiction on Exhibit A 1st Revision. Substantial deviation
therefnan, as determined by staff, shall require review by the
Planning Commission.
The final map shall depict split pads for dwelling units located on
Lots 1 through 4.
The lateral connecting on Lot 4 connecting to the valley gutter shall
be moved to a position outside the dripline of the existing 30" date
palm -
Prior to aacmerKxment of grading, the subdivider shall prepare the
supplemental studies and investigations recamoended on Pages 2 and 3
of the November 10, 1987 letter from Cotton & Associates as contained
in City file 25-,TM-87.

Drainage shall be provided to the satisfaction of the City Engineer.
if the existing 8" rain in Rainbow Drive is deemed inadequate to serve
the subdivision, the City Engineer may require the subdivider to
construct an alternative main, improve the existing main or pursue
other options.
The developer shall fly with the requirements of the Underground
utilities ordinance No. 331 and other related Ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall submit detailed plans showing utility
underground provisions. Said plan shall be subject to prior approval
of the affected Utility provider and the City Engineer.

The project developer shall enter into a development agreement with
the City of Cupertino providing for payment of fees, including but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for undesgrounded of utilities. Said
agreement shall be executed prior to issuance of construction permits.

11. 'IRANSFOLS
Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping
or located underground such that said equipment is not visible from
public street areas.
The developer shall dedicate to the City all waterlines and
appurtenances installed to City Standards, and shall reach an
agreement with San Jose water Works for water service to the subject
development.
13. APPROVED EXHIBITS
The recommendation of approval is based an Exhibits A let Revision and
B of Application 25-JIM-87, except as may be amended by the Conditions
contained in this Resolution.
14. TREE MENTZ
The subdivider shall retain the following trees in accordance with the
preservation specifications appearing in the November 20, 1987 report
from Corporate and Comnarcial Services, as contained in City File
25-'IM-87:
Lot 2: 38" Monterey Pine
29" Redwood
Lot 3: 16" Yucca
Lot 4: 30" Date Palm
subsequent purchasers of individual lots within the subdivision shall
have the discretion to retain or remove existing trees.
15. STREET NAME
Street names for all public streets installed with the subdivision
shall be provided in accordance with the historical street name
policy. Mm name selection shall be subject to city Council approval
concurrently with approval of -the final map.
16. FIRE PROTECTION
The subdivider shall retain the option to provide a city approved fire
sprinkler system for the future residence on Lot 5, or in lieu thereof
to provide an approved fire apparatus turn -around area at the upper
terminus of the driveway serving Lot 5. If the sprinkler option is
chosen at the final map stage, the subdivider shall prepare and record
an appropriate deed restriction; otherwise, the final map shall
reflect appropriate dimensions for the aforesaid fire equipment
turning area.
