De Anza Boulevard Cupertino, California 95014 RESOIITiION NO. 4019 OF THE PLANNING OCeMMSSICN OF THE CITY OF CUPERTINO RECDMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE 1 PARCEL INTO 7 PARCELS WITH LOT SIZES RANGING FROM 6,500 SQ. FT. TO 9,250 SO. FT. SECTION I• FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Tentative Subdivision Map, as described on Page 2 of this Resolution; and • WHEREAS, the necessary public notices have been given as required by the subdivision and Procedural Ordinances of the City of Cupertino, and the Planning Commission has held at least one Public Hearing in regard to the application; and WHEREAS, the Planning Commission finds that the application meets the following requirements: a) That the proposed subdivision map is consistent with the City of Cupertino General Plan and any applicable Specific Plan. b) That the design or improvement of the proposed subdivision is consistent with the General Plan and any applicable Specific Plan. c) That the site is physically suitable for the type and intensity of development contemplated under the approved subdivision. d) That the design of the subdivision or the proposed inprovements are not likely are not likely to cause substantial environmental damage nor substantially and avoidably injure fish and wildlife or their habitat. e) That the design of the subdivision or the type of improvements associated therewith are not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the vicinity of the subdivision. f) That the design of the subdivision and its associated improvements will not conflict with easements acquired by the public at large for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED: That upon careful consideration of maps, exhibits, facts, testimony and other evidence submitted in this matter, the application for Tentative subdivision Map is hereby recommended for approval, subject to the conditions enumerated in this Resolution beginning on Page 2 thereof; and RESOLIMON NO. 4019 (21-rlM-87) 12/14/87 PAGE-2- BE IT FURTHER RESOLVED: That the subconclusions upon which the fin:1iigs and conditions specified in this Resolution are based are contained in the Public Hearing Record concerning Application 21-04-87, as set forth in the Minutes of the Planning Ccmnission Meeting of December 14, 1987, and are incorporated by reference as though fully set forth herein. CONDrrIONS AEKII ISTERED BY THE PUBLIC WORKS DEPARINIENP 1. STR= WIDENING street widening, improvements and dedications shall be provided in accordance with City Standards and specifications and as required by the City Engineer. The subdivider shall provide documentation acceptable to the City Attorney, prior to recordation of the final map, which provides for both temporary and permanent roadway access configurations for the east -west connector adjacent to Lots 2 through 5, east of Blaney Avenue. The subdivider shall provide a minimL= 38 ft. improvement width for said access corridor, and shall retain the option to: a 1. obtain dedication of the southerly eight (8) feet of the adjoining property to the north, or, 2. Adjust the depth of Lots 2 through 5, as shown on Exhibit A -1st Revision, to provide the additional 8 ft. of required right of way. All reconfigured lots nnmst conform with the subdivision and Residential Single-family Zoning Standards. The aforesaid documentation shall provide that, upon development of the property to the north, the access corridor shall be converted to a mini cul-de-sac, as generally described in the informational. Exhibit for 21-�IX--87. The cast of converting the access corridor fran Crary to permanent improvements as well as provision of landscaping therein, shall be borne by the subdivider. The subdivider shall also agree to provide full future improvement of the cul-de-sac on the entire frontage east of the project. Lighting fixtures shall be positioned so as to preclude glare and other forms of visual interference to adjoining properties, and shall be no higher than the maxb= height permitted by the zone in which the site is located. LiT . Fire hydrants shall be located as required by the City. 5. TRAFFIC SIGNS Traffic control signs shall be placed at locations specified by the City. Street trees shall be planted within the Public Right of Way and shall be of a type approved by the City in accordance with Ordinance 125. n••rr Grading shall be as approved and required by the City Engineer in accordance with Ordinance 125. 8. DRAINAGE Drainage shall be provided to the satisfaction of the City Engineer. Surface flow across public sidewalks may be allowed in the R-1, R-2 and R-3 zones unless storm drain facilities are deemed necessary by the City Engineer. Development in all other zoning districts shall be served by on site stone drainage facilities connected to the City storm drainage system. If City storm drains are not available, drainage facilities shall be installed to the satisfaction of the City Engineer. RESOIL]TION NO. 4019 (21-Jn4-87) 12/14/87 PAGE - 4 - 9. The developer shall fly with the requirements of the Undergzouna Utilities Ordinance No. 331 and other related Ordinances and regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility devices. The developer shall submit detailed plans showing utility underground provisions. Said plans shall be subject to prior approval of the affected Utility provider and the City Engineer. The project developer shall enter into a development agreement with the City of Cupertino providing for payment of fees, including but not limited to king and inspection fees, storm drain fees, park j dedication fees and fees for used of utilities. Said wagreement shall be executed prior to issuance of construction permits. 11. TRANSFORKERS Electrical transformers, telephone vaults and similar above ground equipment enclosures shall be screened with fencing and landscaping or located underxgreund such that said equipment is not visible fran public street areas. 12. DEDICATION OF WATER I NES The developer shall dedicate to the City all waterlines and appurtenances installed to City Standards and shall reach an agreement with San Jose water Works for water service to the subject development. TREE RErEMON The subdivider shall retain the specimen Pa&wnod Trees on Lots 1 and 2, as shown on Exhibit A 1st Revision, in accordance with Ordinance No. 778. Subsequent purchasers of individual lats within the subdivision shall have the discretion to retain or resmve existing trees. RESOLUTION NO. 4019 (21-'IM 87) 12/14/87 PAGE - 5 - 15. STREET NAME Street names for all public streets installed with the subdivision shall be provided in accordance with the historical street name policy. The name selection shall be subject to City Council approval concurrently with approval of the final map. 16. STREET ALIGNMENT Staff shall retain the option to adjust the final alignment of the cul-de-sac street improvements depicted on exhibit A-lst. Revision, with the intent of minimizing disruption of existing or future public recreation improvements of the adjacent Wilson School playground site.
