OF THE PLANNING CCUIIffSSION OF THE CITY OF CUPERTINO
REOC MENDING DENIAL OF
A TFNrATIVE MAP TO SUBDIVIDE 2.11 ACRES INTO SIX H MFS=

WHEREAS, the City of Cupertino has received an application for a Tentative
Subdivision Map, as described on Page 2 of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with
the Subdivision and Procedural ordinances of the City of Cupertino, and
the Planning Commission has held one or more Public Hearings on this
matter: and
WHEREAS, the Planning Commission finds as follows with regard to this
application:
1) The proposed Tentative Map is inconsistent with the City's adopted
General Plan and applicable Specific Plan.
2) The design or improvement of the proposed subdivision is
inconsistent with applicable City Standards.
3) The site is not physically suitable for the type of development, nor
the proposed density in the case of a residential application,
envisioned under the proposed subdivision.
4) The design of the subdivision or proposed improvements related
thereto are likely to result in significant environmental
degradation or public health problems.
5) The design of the subdivision or proposed improve ants related
thereto are in conflict with easements, acquired by the public at
large for access through or use of property within the proposed
subdivision.
5) The proposed tentative map conflicts with zoning ordinance
requirements that the units be constructed on the flatter westerly
portions of the site.
WHEREAS, the Commission has recom esxied denial of the Use Permit.
WHEREAS, the plan as presented is not in sufficient accord with the zoning
that governs the property because it does not do the maxitm= to protect
the watershed to Blackberry Farm and the density is too great given the
limited developable area of the site.
NOW, ZME FORE, BE IT RESOLVED
That after careful consideration of maps, facts, exhibits, testimmV and
other evidence submitted in this matter, the application for Tentative Map
is hereby reccmmrerded for denial.

Resolution are based are contained in the Public Hearing record concerning
Application 8RIM-87, as set forth in the Minutes of the planning
Ccomission Meeting of May 11, 1987 and May 26, 1987, and are incorporated
by referenced as though fully set forth herein.
