WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Tentative Subdivision Map, as described on Page 2 of
this Resolution, and
WHEREAS, the necessary public notices have been given as required by the
subdivision and Procedural ordinances of the City of Cupertino, and the
Planning Omission has held at least one Public Hearing in regard to the
application, and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a) That the proposed subdivision map is consistent with the City of
' Cupertino General Plan and any applicable Specific Plan.
b) That the design or improvement of the proposed subdivision is
consistent with the General Plan and any applicable Specific Plan.
c) That the site is physically suitable for the type and intensity of
development contemplated under the approved subdivision.
d) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage nor
substantially and avoidably injure fish and wildlife or their
habitat.
e) That the design of the subdivision or the type of improvements
associated therewith are not detrimental to the health, safety,
peace, morals and general welfare of persons residing or working in
the vicinity of the subdivision.
f) That the design of the subdivision and its associated improvements
will not conflict with easements acquired by the public at large for
access through or use of property within the proposed subdivision.

other evidence submitted in this matter, the application for Tentative
subdivision Map is hereby reccmaended for approval, subject to the
conditions enumerated in this Resolution beginning on Page 2 thereof: and

That the subconclusions upon which the findings and conditions specified
in this Resolution are based are contained in the Public Hearing Record
concerning Application 2-TK-87, as set forth in the Minutes of the
Planning Camd ssicn Meeting of February 9, 1986, and are incorporated by
reference as though fully set forth herein.

1. STREEr WIDENING
Street widening, improvements and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.
Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards as specified by the City
Engineer.

Street lighting shall be installed and shall be as approved by the
City Engineer. Lighting fixtures shall be positioned so as to
preclude glare and other forms of visual interference to adjoining
properties, and shall be no higher than the maximum height permitted
by the zone in which the site is located.

Grading shall be as approved and required by the City Engineer in
accordance with Ordinance 125.
Drainage shall be provided to the satisfaction of the City Engineer.
Surface flow across public sidewalks may be allowed in the R-1, R-2
and R-3 zones unless storm drain facilities are deemed necessary by
the City Engineer. Development in all other zoning districts shall be
served by on site storm drainage facilities connected to the City
storm drainage system. If City storm drains are not available,
drainage facilities shall be installed to the satisfaction of the City
Engineer.
The developer shall couply with the requirements of the underground
utilities ordinance No. 331 and other related ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall submit detailed plans showing utility
underground provisions. said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.
The project developer shall enter into a development agreement with
the City of Cupertino providing for payment of fees, including but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for undergrounding of utilities. said
agreement shall be executed prior to isfmance of construction permits.
11. MCCLEIiAN ROAD
The applicant shall install street inprovements along the propertyrs
McClellan Road frontage as required by the Department of Public
Works. These improvements shall include sidewalk, curb, and gutters.

a. The applicant shall dedicate and install Imperial Avenue from
Nociellan Raced to the property's northern boundary, subject to the
approval of the Public Works Department. The new road shall
connect with the existing portion of Imperial Avenue, which
currently terminates at the subject property. The road shall have
a conventional 56 ft. right-of-way. The 50 ft. and 53 ft "necks"
shown in Exhibit A 1st Revision shall be eliminated.
b. The City shall install a new barricade on Imperial Avenue at the
boundary between the industrially and residentially zoned
properties. The applicant shall pay for the installation costs of
the barrier. The existing barrier located at the southern
terminus of Imperial Avenue (northern boundary of project site)
shall be removed following erection of the new barrier referenced
above and upon issuance of final building permits for 50 percent
of the lots in the subdivision.
13. AICAM AVENUE
a. The applicant shall dedicate and install Alcazar Avenue from the
westerly property line to Inperi.al Avenue as shown in Exhibit A
1st Revision, subject to the approval of the Public Works
Department. However, the proposed street shall be shifted south
to align with the existing terminus of Alcazar Avenue in a
straight line. The lot lines for lots 3-11 shall be adjusted as
necessary to provide additional dedication, but a minimum 7,200
sq. ft. lot size and 60 ft. lot widths shall be maintained.
b. The Public Works Department shall coordinate with the County to
obtain the dedication necessary to connect the existing portion of
Alcazar Avenue with the above extension.
14. CRAINAGE EASFS>F3dP
The applicant shall provide an overland drainage release at the
northeast corner of the property. This may be accomplished by
obtaining an easement over the adjoining easterly property, regrading
Tot 12 to drain to Inperial Avenue, or another approach, subject to
the approval of the Public works Department.
SEcrioN IV: CONDITIONS OF APPROVAL AUGNISTERED BY TM PUNNING DEP
The recommendation of approval is based on Exhibit A -1st Revision,
except as may be amended by the Conditions contained in this
Resolution.
16. AAZ.ARmtiG CHEHIICALS
The applicant shall demnstrate that the DDr contaminated soil has
been removed prior to release of building permits.

17. DEMOLITION REQUIREMENT
All existing structures on the site shall be removed prior to or
concurrently with project construction. The developer shall assume
the responsibility to obtain all required demolition permits in
accordance with City Ordinances.
18. ABANDONED WATER WELLS
The property owner shall seal abandoned or unused water wells if the
City, after consultation with the Santa Clara Valley Water District,
determines that said abandoned or unused water wells have a potential
to contaminate the water supply.
