PC Reso 1544 15--TM-7 6 RESOLUTION NO. 1544 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE 11.6 ACRES INTO TWENTY-SEVEN (27) LOTS. APPLICANT: Lohr-Turgeon Development Co. ADDRESS: 1741 Saratoga Avenue, San Jose, California 95129 SUBMITTED: May 7, 1976 LOCATION: Southerly terminus of Scenic Blvd. adjacent to Stevens Creek (stream bed) . ACREAGE: 11.6 acres CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is based upon Exhibits A and B of 15-TM-76, as may be modified by additional conditions contained herein. 16. Rivera Road shall be dedicated, if not already a public street, and improved to the edge of the property in a location as approved by the Director of Public Works. 17. Cut and fill slopes adjacent to public roadways shall be planted with suitable materials to prevent erosion. The method of irrigation shall be approved by the Director of Public Works. 18. The road pavement sections shall be as follows : a) Scenic Blvd. and Scenic Circle - 32' face of curb to face of curb. Sidewalk on one side. b) Scenic Court and Rivera Road: 30 ft. face of curb to face of curb. Sidewalk on one side. 19. The developer shall install protective barricades along the drip lines of all trees bordering the creek and public rights of way to protect said trees from construction activities. All trees shall be retained. 20. The developer shall provide 15 gallon size trees to be planted in the flood plain environment to visually isolate the development from the McClellan Ranch Park site. The location and species of trees shall be determined by the Director of Parks and Recreation. The intent of this condition is not to completely isolate the develop- ment from McClellan Ranch Park but rather soften the visual impact of the development. The number of required trees shall be limited to twenty (20) . -2- C I T,Y OF CUPERTINO City Hall, 10300 Torre Avenue 411 Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A TENTATIVE MAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative map; and WHEREAS, the Planning Co«uuission has held at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings : a) That the proposed map is consistent with the general and specific plans. b) That the design or improvement of the proposed subdivision is consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. • -1- • 15-TM-76 Resolution No. 1544 (continued) Ilk21. The Conditions, Covenants, and Restrictions of the development shall include a statement informing potential buyers that the property is contiguous to a public park, that said park is presently designated for low intensity uses and thus will be maintained in a natural state, and that the property is contiguous to the Blackberry Farm Recreation Center which is a source of noise. 22. The developer shall participate in the construction costs of a creek crossing if said creek crossing is approved by the Parks and Recreation Commission and City Council. Said participation shall not exceed $2,000.00.
